In the draft Law on Criminal Enforcement (amended), the Ministry of Public Security proposed adding regulations for prisoners to donate human tissues and body parts.

The Ministry of Justice is appraising the proposal to draft the Law on Enforcement of Criminal Judgments (amended) drafted by the Ministry of Public Security.

The draft law proposes to add a new article (Article 55a) compared to the 2019 Law on Criminal Enforcement, to address cases where prisoners wish to donate tissue or part of their human body.

Accordingly, in case a prisoner wishes to donate organs, the detention facility shall coordinate with the Department of Health in the area where the unit is stationed to determine a medical facility that is qualified to collect human tissues and body parts.

Within 5 days after assessing the health status of the prisoner after donating tissue or a part of the body, the head of the detention facility shall report to the criminal enforcement management agency of the Ministry of Public Security or the Ministry of National Defense for consideration and decision.

Five days after receiving the report, the criminal enforcement agency (Ministry of Public Security or Ministry of National Defense) shall respond in writing regarding its approval or disapproval. If it does not agree, the reasons must be clearly stated.

Qualified medical facilities shall coordinate with prison facilities to implement procedures, policies, and procedures for prisoners donating tissues and body parts in accordance with legal regulations in this field.

According to the draft law, medical facilities are responsible for confirming the health recovery of prisoners after donating tissue or body parts and notifying the prison facility to bring the prisoner back to continue serving his sentence.

The Government will issue regulations providing detailed guidance on the above procedures.

The Ministry of Public Security plans to submit to the 15th National Assembly a proposal to build a draft Law on Execution of Criminal Judgments (amended) into the National Assembly's 2024 law and ordinance building program.
