The Politburo requested to urgently review and amend legal documents with regulations on the number of children and Instruction No. 05 in the direction of not disciplining cases of giving birth to a third child or more.

The Central Party Office has just sent a document to the Central Inspection Commission, the Government Party Committee, the National Assembly Party Committee, and the Ministry of Health Party Committee on the preliminary review of the implementation of Resolution No. 21 of the Central Committee on population work in the new situation, and amendments to Party and State regulations related to population work.

Accordingly, at the meeting on February 14, the Politburo considered the proposal of the Central Inspection Commission on reviewing Party regulations related to handling violations of population policy, and the report of the Party Committee of the Ministry of Health on 7 years of implementing Resolution 21 of the 12th Central Committee.

The Politburo assigned the Central Inspection Commission to advise and amend the regulations of the Central Committee, the Politburo, and the Secretariat related to handling violations of population policy and proactively amend Instruction No. 05 dated November 22, 2022 of the Central Inspection Commission in the direction of not disciplining cases of giving birth to a third child or more.

Not retroactively applying disciplinary measures to cases that have been handled is also a policy agreed upon by the Politburo.

The Politburo agreed to issue a conclusion on continuing to implement Resolution No. 21 related to population work in the new situation, and at the same time assigned the Government Party Committee to direct the Ministry of Health Party Committee to study and absorb opinions to complete the Politburo's conclusion, and submit it to the Standing Secretariat for consideration and promulgation.

The Politburo assigned the National Assembly Party Committee and the Government Party Committee to coordinate in leading and directing the acceleration of the progress of drafting and submitting to the National Assembly for approval the Population Law in the spirit of the Resolution of the 13th National Party Congress in 2025.

In the immediate future, the Politburo requires urgent review and amendment of legal documents with regulations on the number of children, to be completed in the first quarter of 2025.

The Politburo assigned the Government Party Committee and the Central Public Security Party Committee to urgently direct the completion of the construction and synchronous connection of human data on the original database, which is the national population database, to accurately assess population fluctuations, both in quantity and quality.

This is to serve accurately, promptly and effectively the planning and implementation of population policies in the coming time.

In early January, the Ministry of Health submitted to competent authorities for approval a policy to abolish regulations on handling violations of population policies that are no longer appropriate, initially abolishing the handling of violations of regulations on the number of children.

According to current regulations, Party members who have a third child are considered to violate population policy and may be subject to disciplinary action, except in a few specific cases.
