This regulation takes effect from the date of signing (July 11, 2023), replacing Regulation No. 205-QD/TW dated September 23, 2019 of the Politburo on controlling power in personnel work and combating the abuse of power and positions.

The subjects of application are organizations and individuals with authority, responsibility and involvement in personnel work.
Regulation 114-QD/TW clearly states acts of taking advantage of and abusing one's position and power, including: Using one's own prestige and influence and that of family members to suggest, influence, and pressure others to decide, direct, advise, propose, comment, evaluate, vote, take a vote of confidence, vote to recommend personnel, and vote according to one's own will;
Allowing people with family relationships or close acquaintances to take advantage of their positions, powers, and prestige to influence, manipulate, and interfere in all stages of personnel work;
Integrating personal intentions when carrying out stages of personnel work for the purpose of personal gain or benefit to personnel in the process of carrying out personnel work;
Directing and advising on all stages of personnel work according to regulations for personnel who do not meet the requirements and standards; do not comply with principles, regulations, processes, rules, and decisions;

The regulation clearly states the responsibility for controlling power and preventing corruption and negativity in personnel work. It clearly stipulates the responsibility of Party committees, Party organizations, and collective leadership; the responsibility of members of Party committees, Party organizations, and collective leadership; the responsibility of heads of Party committees, Party organizations, and collective leadership; the responsibility of heads of advisory agencies, advisory staff, personnel, etc.
Regulation 114-QD/TW clearly states the handling measures of competent authorities when there are violations by cadres, party members, civil servants, and public employees. Corrupt and negative acts in personnel work with violations will be transferred to competent agencies for consideration and handling according to regulations.
