Ensuring the 2024 Land Law soon comes into effect

The 2024 Land Law has many new and important breakthrough contents, contributing to the goal of perfecting institutions and policies, improving the effectiveness and efficiency of land management and use.

The 2024 Land Law has 97 contents assigned to the Government for detailed regulations, and 9 contents assigned to ministries for implementation guidance.

In order for the Land Law to soon come into effect, detailed regulations must take effect in sync with the enforcement of the law.

This was emphasized by Chairman of the National Assembly's Economic Committee Vu Hong Thanh when speaking at the second national conference to implement laws and resolutions of the 6th Session and 5th Extraordinary Session of the 15th National Assembly on the morning of March 7.

According to Chairman Vu Hong Thanh, in 2024, it is expected to issue decrees implementing the Land Law on the following contents: Detailed regulations on the implementation of a number of articles of the Land Law; Regulations on basic land survey; registration, granting of land use right certificates, ownership of assets attached to land and land information system; Regulations on compensation, support, resettlement when the State recovers land; Regulations on land development fund; Regulations on land use fee collection, land rent; Regulations on land prices; Detailed regulations on rice-growing land; Regulations on sea encroachment; Regulations on sanctioning administrative violations in the land sector.

The guiding circulars are stipulated in the law on the following contents: Regulations on technical land investigation and evaluation; techniques for land protection, improvement and restoration; Regulations on land statistics, inventory and mapping of current land use status; Regulations on cadastral records, certificates of land use rights, ownership of assets attached to land; Regulations on the content, structure and type of information in the national land database; Regulations on collection levels, collection, payment, management and use of fees for exploitation and use of land documents; Regulations on the establishment and management of administrative unit boundary records and guidance on resolving cases of disagreement on administrative unit boundaries.

Implementing the provisions of the Law on Promulgation of Legal Documents, the Economic Committee, the Ethnic Council, and the Committees of the National Assembly within their respective areas will supervise the promulgation of decrees and circulars detailing the contents assigned in the Land Law, focusing on the conformity of the decrees and circulars with the law in terms of content, form, and promulgation authority... ensuring that the decrees and circulars must provide complete and consistent details with the policy contents stipulated in the 2024 Land Law; ensuring the inheritance, stability, and development of the land law system; consistency and synchronization with documents detailing the Housing Law, the Law on Real Estate Business, and the legal system.

After the law is promulgated, the work of organizing law enforcement is an extremely important and necessary step so that the policies and regulations of the law can be put into practice and become effective soon.

According to Deputy Minister Le Minh Ngan, according to the Prime Minister's decision, the Ministry of Natural Resources and Environment was assigned to draft 10 documents including 6 decrees and 4 circulars.

For the decrees assigned to the Ministry of Natural Resources and Environment to preside over, the Ministry promptly established a Drafting Committee, an Editorial Team, posted them on the Government's electronic information portal, and the Ministry of Natural Resources and Environment sought opinions from affected subjects, sent them to relevant localities, ministries, and organizations for comments, and organized conferences in regions to solicit comments on the draft decrees.

Circulars have been urgently developed by agencies in accordance with the provisions of the Law on Promulgation of Legal Documents.

The implementing guidelines will be submitted to the competent authority for consideration and approval in May 2024. In particular, the decree on sea encroachment activities will be submitted in March 2024 according to the simplified procedure to take effect from April 1, 2024.

The Ministry of Natural Resources and Environment shall preside over and coordinate with relevant ministries, branches and units to develop a project to report to the Government and submit to the National Assembly on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights for other land to submit to competent authorities as soon as possible to ensure progress.
