On March 5, the Prime Minister issued Decision No. 222/QD-TTg promulgating the Plan to implement Land Law No. 31/2024/QH15.
The plan is issued to organize the implementation of the Land Law to ensure timeliness, uniformity, uniformity, effectiveness and efficiency; determine the work contents, completion deadlines and responsibilities of relevant agencies and organizations in organizing the implementation of the Law; raise awareness of the Land Law and the responsibilities of all levels, sectors and localities in implementing the Land Law.
The requirement is to ensure unified direction from the Government and the Prime Minister; close, regular and effective coordination between ministries, ministerial-level agencies, Government agencies, People's Committees of provinces and centrally-run cities and relevant agencies and organizations in implementing the Land Law. Determine a specific roadmap to ensure that the Land Law and documents detailing the Land Law are implemented uniformly and synchronously nationwide from the date the Law takes effect. Regularly and promptly inspect, urge, guide the removal and resolution of problems and difficulties arising during the implementation process to ensure the progress and effectiveness of the implementation of the Land Law.
The Prime Minister assigned the agencies to take charge of drafting 16 documents detailing the Land Law under the authority of the Government, the Prime Minister, and the Minister. Specifically, the Ministry of Natural Resources and Environment shall take charge of and coordinate with relevant ministries and branches to develop and submit to the Government for promulgation 6 Decrees; issue under its authority 4 circulars to detail the Land Law. The Ministry of Finance shall take charge of and coordinate with relevant ministries and branches to develop and submit to the Government for promulgation 2 Decrees; issue under its authority 1 circular to detail the Land Law.
The Ministry of Agriculture and Rural Development shall preside over and coordinate with relevant ministries and branches to develop and submit to the Government for promulgation 1 Decree to detail the Land Law; update and supplement the draft Decree amending and supplementing Decree No. 156/2018/ND-CP of the Government detailing the implementation of a number of articles of the Forestry Law with the content assigned in Article 248 of the Land Law. The Ministry of Labor, War Invalids and Social Affairs shall preside over and coordinate with relevant ministries and branches to develop and submit to the Prime Minister for promulgation 1 Decision to detail the Land Law. The Ministry of Home Affairs shall issue 1 circular to detail the Land Law.
The Prime Minister requested ministries, branches and localities to urgently develop, in accordance with the procedures prescribed in the Law on Promulgation of Legal Documents, to submit to the Government for promulgation and promulgate according to their authority in May 2024. Regarding the draft Decree regulating sea encroachment according to the assigned tasks in Article 190 of the 2024 Land Law: The Ministry of Natural Resources and Environment shall develop, complete and submit for promulgation the Decree according to the shortened procedure to ensure it takes effect from April 1, 2024.
The Prime Minister requested the Ministry of Natural Resources and Environment to be responsible for developing and implementing a program to disseminate and educate about land laws to raise awareness of land policies and laws for domestic organizations, religious organizations, affiliated religious organizations, domestic individuals, overseas Vietnamese who are Vietnamese citizens and communities; paying special attention to ethnic minorities. At the same time, promote dissemination and propaganda on the Electronic Information Portal/Page, National Database of Legal Documents.
The Ministry of Natural Resources and Environment shall preside over and coordinate with the Ministry of Information and Communications, ministries, branches and localities to develop a propaganda project including training for People's Committees and officials working in land management at all levels; policy communication for people and businesses on new provisions of the Law and documents detailing the implementation of the Law.
The Ministry of Information and Communications directs central and local news agencies and press to have plans to propagate and disseminate land laws in various forms to each organization and each citizen; directs the publication and distribution of publications on land laws, including publications in ethnic languages, for widespread dissemination to people in all regions and areas nationwide.
Voice of Vietnam, Vietnam Television, Vietnam News Agency, Nhan Dan Newspaper, news agencies and newspapers are responsible for disseminating and popularizing land laws; opening special pages and columns to introduce important innovations of the Land Law.
The Prime Minister requested the Central Propaganda Department to pay attention to directing the dissemination of the Land Law so that the Party's guidelines and policies on land are widely disseminated among the people, soon put into practice, and promote effectiveness and efficiency in land management and use. He requested the Vietnam Fatherland Front and its member organizations such as the Vietnam Farmers' Union, the Vietnam Women's Union, the Vietnam General Confederation of Labor, the Ho Chi Minh Communist Youth Union and other member organizations of the Front to develop and implement a program to disseminate land laws to its members.
Dissemination and education of land law must be carried out regularly and continuously with practical content and appropriate forms for each subject. In the immediate future, in the first and second quarters of 2024, a campaign will be launched to widely disseminate and propagate the Land Law before the Land Law comes into effect.
The Prime Minister assigned the Ministry of Natural Resources and Environment to preside over and coordinate with the Ministries of Construction, Justice, Planning and Investment and relevant ministries and branches to develop a Project for the Government to submit to the National Assembly on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights for other land according to Notice No. 3270/TB-TTKQH dated January 11, 2024 of the Secretary General of the National Assembly and instructions in Official Dispatch No. 294/VPCP-PL dated January 14, 2024 of the Government Office, submission deadline is before March 10, 2024.
The Prime Minister assigned the Ministry of Planning and Investment to preside over and coordinate with the Ministry of Natural Resources and Environment and relevant ministries and branches to develop a pilot Resolution on separating site clearance and resettlement from investment projects, to be submitted before March 10, 2024; assigned the Ministry of Justice to preside over and coordinate with the Ministry of Natural Resources and Environment and the Ministry of Planning and Investment to report to the National Assembly Standing Committee for permission to include the above two pilot projects in the National Assembly's Working Program at the 7th Session of the 15th National Assembly in May 2024.
