What are the outstanding new points of the 260 articles of the 2024 Land Law?

On the afternoon of March 6, Comrade Dang Quoc Khanh, member of the Party Central Committee, Minister of Natural Resources and Environment chaired a conference on implementing the 2024 Land Law. The conference was held online in 63 provinces and cities across the country.

The 2024 Land Law consists of 16 chapters and 260 articles, of which 180/212 articles of the 2013 Land Law are amended and supplemented, and 78 new articles are added.

Some notable new points include inheriting and perfecting 27 concepts, adding 22 concepts, removing 2 concepts (public service organizations, economic organizations because they have been defined in the Law on Management and Use of Public Assets, the Investment Law), and transferring 1 concept (land for underground construction). Adding concentrated livestock land to the agricultural land group, adding land for water supply and drainage works, land for natural disaster prevention works, information technology land, ash storage facilities, and wholesale market land to the non-agricultural land group.

Stipulate 4 forms of compensation, including land with the same purpose of use as the recovered land, land with a different purpose of use than the recovered land, money, and housing. Supplement the regulation that people whose residential land is recovered are given priority to choose the form of compensation in money if needed and must register when making a compensation, support, and resettlement plan. Supplement the regulation on compensation, support, and resettlement payments for owners of assets attached to land to resolve cases where on the same plot of land, the land user and the owner of the asset are 2 different subjects.

Stipulate 8 cases of land allocation without land use fee collection, 4 cases of land allocation with land use fee collection; cases of land lease with one-time land rent collection. Decentralize all authority to permit conversion of land use purposes for rice cultivation, protective forest land, and special-use forest land to local authorities.

Clearly stipulate 4 sources of input information for land valuation according to land valuation methods, including land prices recorded in the National Land Database, National Price Database; land prices recorded in land use rights transfer contracts, winning prices in land use rights auctions after completing financial obligations; land prices collected through investigation and survey in cases where there is no land price information; information on revenue, expenses, and income from land use.

Regulations on 4 methods of land valuation, including comparison, income, surplus, land price adjustment coefficient; regulations on land price tables. In particular, regulations on areas where there is a land price table for each plot of land based on the standard land value area, the specific land price is determined according to the land price table at the time of land valuation.

The 2024 Land Law stipulates that the agency handling administrative procedures on land is responsible for the correct authority and time as prescribed by law, and is not responsible for the contents of documents and papers in the dossier that have been previously approved, appraised, ratified or resolved by other competent agencies or individuals.
