When hearing her subordinates report that they could not adjust the financial statements submitted to the tax authorities, Ms. Nguyen Thi Thanh Nhan directed her subordinates to do it at all costs to qualify for the bidding at the Quang Ninh Maternity and Pediatrics Hospital Project.
The Investigation Police Agency of the Ministry of Public Security has just completed the investigation conclusion of the case of Violating bidding regulations causing serious consequences; Lack of responsibility causing serious consequences occurring at the Department of Health of Quang Ninh province, AIC Company and related units.
The investigation agency proposed to prosecute Ms. Nguyen Thi Thanh Nhan and 13 others for the crime of Violating bidding regulations causing serious consequences; proposed to prosecute Ms. Le Thi Phu (former Deputy Head of Price Management Department, Department of Finance of Quang Ninh province) and Mr. Luong Van Tam (former Director of Project Management Board, Department of Health) for the crime of Lack of responsibility causing serious consequences.

Previously, in January 2023, Ms. Nhan received a 16-year prison sentence for violating bidding regulations causing serious consequences and 14 years in prison for bribery.
In this case, the investigation concluded that Ms. Nguyen Thi Thanh Nhan knew that AIC Company did not have sufficient financial capacity. If the company bid for the Quang Ninh Maternity and Pediatrics Hospital Project, it would not win the bid.
However, in order for AIC Company and Mopha Company (a company founded by Ms. Nhan) to win 6 bid packages at the Quang Ninh Maternity and Pediatrics Hospital Project, Ms. Nhan directed Mr. Do Van Son (chief accountant) to adjust the short-term debt payment coefficient in the Financial Reports of 2010, 2011, 2012 to participate in the bid.
At the same time, he directed Nguyen Hong Son (Deputy General Director), Truong Thi Loan (Head of Project Management Board 3) and employees of AIC Company and Mopha Company to collude with the investor and CIMEICO Valuation Company in the process of establishing and determining the procurement list, appraising the bid package price, approving the budget, bidding plan, and organizing the bidding.
The investigation results showed that AIC Company won the bids, but the financial report for the 3 years 2010-2012 of AIC Company was prepared by Ms. Nguyen Thi Thanh Nhan, Chairwoman of the Board of Directors, andGeneral DirectorAIC and Do Van Son (chief accountant) signed and provided the investor with financial statements that were not consistent with the financial statements submitted to the tax authorities.
The actual financial statements sent to the tax authority in 2010, 2011, 2012 had a short-term debt payment ratio of less than 1. Ms. Nhan directed Mr. Do Van Son to increase "short-term assets" and decrease "short-term debt" on the financial statements in 2010, 2011, 2012 so that the debt payment ratio was greater than or equal to 1. Then, hired an auditing company to confirm with the purpose of qualifying for bidding.
The investigation concluded that AIC Company had committed fraud and violated prohibited acts in bidding.
Wrong instructions of Ms. Nguyen Thi Thanh Nhan
According to Mr. Do Van Son's testimony, at the end of 2013, the defendant was called to the office by Ms. Nhan and instructed to adjust the short-term debt payment ratio to be greater than 1, meaning that short-term assets/short-term debt must be greater than 1 in the financial statements of AIC Company from 2010-2013, to serve the business activities and bidding of AIC Company.
According to Mr. Do Van Son's testimony, at that time the defendant replied to Ms. Nhan that it could not be adjusted, because in reality the short-term debt payment ratio of AIC Company was only approximately equal to 1 and the financial reports of the years had also been submitted to the tax authority.
Hearing the report, Mrs. Nhan instructed that they should take care of it themselves. After being scolded by his boss, Mr. Do Van Son returned to his office and instructed Le Thi Huong (Deputy Head of Accounting and General Accountant) to follow Mrs. Nhan's instructions.
When Huong said: "How can we adjust it now?", Mr. Do Van Son replied: "We have no other choice, we have to do it."
According to the investigation conclusion, to ensure that AIC Company and Mopha Company won the bid, Ms. Nguyen Thi Thanh Nhan directed her subordinates to collude with the investor on technical specifications, configurations and prices of purchased equipment, and at the same time used contractors in the ecosystem and partner companies outside the ecosystem as "blue troops" to bid.
The investigation agency determined that Ms. Nguyen Thi Thanh Nhan let her brother Nguyen Anh Dung stand in the name of General Director and legal representative of Phuc Hung Company to sign the bidding documents, acting as a "blue team" for AIC Company to win the bid.
As a result, AIC Company won 4 bids, Mopha Company won 2 bids to purchase equipment for the Obstetrics and Pediatrics Hospital with a total amount of 232.19 billion VND. Through winning 6 bids, Ms. Nhan and her accomplices caused the State a loss of more than 50 billion VND.
