Today, the trial of Ms. Nguyen Thi Thanh Nhan in the 5th case

Today, the Hanoi People's Court brought Ms. Nguyen Thi Thanh Nhan (former Chairwoman of AIC Company) and 12 other defendants to trial for violating bidding regulations causing serious consequences.

This is a case of violations that occurred in the project “Procurement of equipment and hiring of technical services to monitor, analyze incidents, and network information security attacks on some international Internet connection channels” invested by the Vietnam Computer Emergency Response Center (VNCERT); it is also the 5th case in which Ms. Nhan has been brought to trial.

In this case, Ms. Nguyen Thi Thanh Nhan is accused of being the mastermind, leader, and director of violations of bidding regulations.

According to the accusation, during the implementation of the bidding package "Procurement of equipment and hiring of technical services to monitor and analyze incidents and network information security attacks on a number of international Internet connection channels", the Vietnam Computer Emergency Response Center (VNCERT) committed violations.

Specifically, when conducting the bidding for Package No. 8 "Investment in purchasing equipment and software systems", the defendants from the investor, contractor, price appraisal unit, and project consulting unit colluded and cheated in the bidding, violating bidding regulations, allowing AIC Company to win Package No. 8 of the Project, causing damage to the State of more than 17 billion VND.

The Chairman of AIC was accused of fraud in preparing bidding documents, allowing AIC Company to win package No. 8, with a total value of more than 70 billion VND.

Although the contractor AIC did not meet the assessment requirements on contract capacity and key personnel, the defendant investor group still prepared an assessment report assessing AIC Company as a contractor that met the technical requirements and was allowed to participate in opening the financial proposal.

On November 22, 2017, Mr. Nguyen Trong Duong (former Director of VNCERT) signed a decision approving AIC Company as the winning contractor for package No. 8.

After the bidding, Mr. Duong received 1 billion VND from AIC Company and assigned Duong Thi Minh, Chief Accountant of VNCERT, to divide it among the members participating in the project on the occasion of Lunar New Year 2019. Of which, Mr. Duong received 200 million VND, some other defendants received from 20-50 million VND. The remaining amount was used for general activities of VNCERT.

The trial is expected to last until March 24, with Judge Liu Yujing presiding.

First instance judgment No. 5/2023/HS-ST dated January 4, 2023 of the Hanoi People's Court and appeal judgment No. 389/2023/HS-PT dated May 24, 2023 of the Hanoi High People's Court sentenced Nguyen Thi Thanh Nhan to 16 years in prison for "violating bidding regulations causing serious consequences" and 14 years in prison for "giving bribes". The total sentence for the two crimes is 30 years in prison.

First Instance Judgment No. 120/2023/HS-ST dated October 26, 2023 of the People's Court of Quang Ninh Province and Appeal Judgment No. 154/2024/HSPT dated February 26, 2024 of the High People's Court in Hanoi sentenced Ms. Nguyen Thi Thanh Nhan to 10 years in prison for "violating bidding regulations causing serious consequences". The total sentence of the judgments is 30 years in prison.

First Instance Judgment No. 336/2024/HS-ST dated July 12, 2024 of the People's Court of Ho Chi Minh City and Appeal Judgment No. 973/2024/HS-PT dated October 8, 2024 of the High People's Court in Ho Chi Minh City sentenced Ms. Nguyen Thi Thanh Nhan to 12 years in prison for "violating bidding regulations causing serious consequences" and 12 years in prison for "giving bribes". The total sentence of the judgments is 30 years in prison.

First Instance Judgment No. 144/2024/HS-ST dated November 1, 2024 of the People's Court of Bac Ninh province sentenced Ms. Nhan to 13 years in prison for the crime of "Giving bribes". The total sentence of the sentences requires the Chairman of AIC to serve a total sentence of 30 years in prison.
