Prosecution of defendant Nguyen Thi Thanh Nhan in the VNCERT Center case

Nguyen Thi Thanh Nhan and 12 other defendants in the case of violating bidding regulations causing serious consequences at the Vietnam Computer Emergency Response Center (VNCERT) were prosecuted for trial.

The Supreme People's Procuracy has completed the indictment to prosecute Nguyen Thi Thanh Nhan and 12 other defendants in the case of "violating bidding regulations causing serious consequences" occurring at the Vietnam Computer Emergency Response Center (VNCERT) under the Ministry of Information and Communications, International Progress Joint Stock Company (AIC Company) and related units.

Among the defendants, former Chairwoman of AIC Company Nguyen Thi Thanh Nhan is on the run; the Ministry of Public Security's Investigation Police Agency has issued a national, international, and special wanted notice on June 29, 2023.

The Supreme People's Procuracy (Department 3) prosecuted and brought to the Hanoi People's Court to try defendant Nguyen Thi Thanh Nhan (Chairwoman of AIC Company) and 12 other defendants in the case at VNCERT Center for the crime of "violating bidding regulations causing serious consequences," as prescribed in Clause 3, Article 222 of the Penal Code.

Previously, defendant Nguyen Thi Thanh Nhan was tried in 4 cases. In the First Instance Judgment No. 05 dated January 4, 2023 of the Hanoi People's Court and the Appeal Judgment No. 389 dated May 24, 2023 of the Hanoi High People's Court, Nguyen Thi Thanh Nhan was sentenced to 16 years in prison for "violating bidding regulations causing serious consequences" and 14 years in prison for "giving bribes." The total sentence for the 2 crimes is 30 years in prison.

First Instance Judgment No. 120 dated October 26, 2023 of the People's Court of Quang Ninh Province and Appeal Judgment No. 154 dated February 26, 2024 of the High People's Court in Hanoi sentenced Nguyen Thi Thanh Nhan to 10 years in prison for "violating bidding regulations causing serious consequences." The combined sentence of the judgments is 30 years in prison.

First Instance Judgment No. 336 dated July 12, 2024 of the People's Court of Ho Chi Minh City and Appeal Judgment No. 973 dated October 8, 2024 of the High People's Court in Ho Chi Minh City sentenced Nguyen Thi Thanh Nhan to 12 years in prison for "violating bidding regulations causing serious consequences," and 12 years in prison for "giving bribes." The combined sentence of the judgments is 30 years in prison.

First Instance Judgment No. 144 dated November 1, 2024 of the People's Court of Bac Ninh province sentenced Nguyen Thi Thanh Nhan to 13 years in prison for "bribery." The total sentence forced Nguyen Thi Thanh Nhan to serve the combined sentence of the sentences is 30 years in prison.

According to the indictment of the Supreme People's Procuracy, the project "Procurement of equipment and hiring of technical services to monitor and analyze incidents and network information security attacks on a number of international Internet connection channels" was invested by VNCERT.

In the above project, there was a bidding process for Package No. 08 "Investment in purchasing equipment and software systems" in the form of domestic open bidding. The defendants belonging to the investor, contractor, price appraisal unit, and project consulting unit committed acts of collusion and fraud in bidding, violating bidding regulations, allowing AIC Company to win Package No. 08 of the project, causing damage to the State of more than 17.2 billion VND.
