Procedures for investing in urgent public investment projects to overcome the consequences of storm No. 3 in Hai Duong

Accordingly, the Chairman of the People's Committee at all levels decides and is responsible for the implementation of urgent public investment projects under his/her management. Urgent public investment projects do not have to go through the procedure of deciding on investment policy.

Chairmen of People's Committees at all levels decide to invest in urgent public investment projects according to the following procedures: Assign specialized agencies or units with the function of organizing surveys and preparing project proposal reports. Assign specialized agencies to manage public investment or units with the function of appraising projects. Direct agencies and units assigned to prepare project proposal reports to be responsible for completing project proposal reports for submission and approval according to the provisions of Article 35 of the Law on Public Investment.

The Chairman of the People's Committee reports to the People's Council of the same level on the implementation of urgent public investment projects at the nearest session.

Regarding contractor selection: Relevant departments, branches, localities and units proactively apply the most appropriate form of contractor selection to ensure that contractor selection is carried out quickly and effectively, meeting the requirements for immediate remediation or timely handling of consequences caused by storm No. 3 and post-storm floods.

Apply the shortened bidding process prescribed in Clause 2, Article 78 of Decree No. 24/2024/ND-CP to bidding packages implemented to immediately remedy or promptly handle the consequences caused by storm No. 3 and post-storm floods in cases such as: reinforcing dikes, handling landslides on river banks in vulnerable areas; repairing and maintaining bridges and roads; handling works at risk of losing load-bearing safety; supporting and transporting
transport, purchase food for famine relief and disaster relief; purchase medicine, chemicals, testing supplies, medical equipment, search and rescue...

Note: Urgently identify and assign capable and experienced contractors to immediately implement bidding packages to overcome the consequences of storm No. 3 and post-storm floods. Speed ​​up the completion of the simplified bidding procedure (according to the provisions of the 2023 Bidding Law and Decree No. 24/2024/ND-CP); no need to approve the contractor selection plan; no need to prepare a request for proposal; no need to request contractors to submit proposal documents for evaluation. The determination of bidding package prices must comply with the provisions of Article 16 of Decree No. 24/2024/ND-CP. Publicize the bidding results on the National Bidding Network, ensuring publicity and transparency.

In case of difficulties or problems during the implementation process, relevant departments, branches, localities and units are requested to promptly report to the Department of Planning and Investment for guidance or report to competent authorities for consideration and resolution.
