Implementing the plan to implement the Law on Consumer Protection

The Minister of Industry and Trade has just issued the Plan of the Ministry of Industry and Trade (attached to Decision No. 2720/QD-BCT) on the implementation of Decision No. 1012/QD-TTg dated August 31, 2023 of the Prime Minister promulgating the Plan to implement the Law on Consumer Rights Protection.

The plan aims to specifically identify the work contents under the responsibility of the Ministry of Industry and Trade, the presiding unit, the coordinating unit and the completion time in organizing the implementation of Decision No. 1012/QD-TTg dated August 31, 2023 of the Prime Minister as well as implementing the Law on Consumer Protection.

Specifically, develop and compile documents to disseminate, propagate, and provide in-depth training on the contents of the Law on Consumer Rights Protection for relevant agencies and organizations to refer to and use consistently nationwide.

On the other hand, organize conferences to disseminate, disseminate and provide in-depth training on the Law on Consumer Rights Protection, legal documents detailing this Law and related legal documents for officials and civil servants working as consultants and state managers on consumer rights protection at central agencies and People's Committees of provinces and centrally-run cities. At the same time, organize propaganda and dissemination of the content of the Law on Consumer Rights Protection and new points of the Law in diverse forms, suitable to actual conditions and situations.

The plan also clearly states the organization of implementation of columns, programs, news, and articles disseminating the Law on Consumer Rights Protection, legal documents detailing this Law, and related legal documents on mass media or other forms as prescribed by law on dissemination and legal education.

In addition, organize the review of legal documents, directives and instructions of ministries, branches and localities on consumer rights protection; urge and guide ministries, branches and localities to organize the review of legal documents, directives and instructions on consumer rights protection.

In particular, synthesize the review results and proposals of ministries, ministerial-level agencies, People's Committees of provinces and centrally run cities to submit to the Government and Prime Minister for consideration of amending, supplementing or promulgating new relevant legal documents.

In addition, develop and promulgate legal documents detailing and guiding the implementation of the Law on Consumer Rights Protection; develop a Government Decree detailing a number of articles and guiding the implementation of the Law on Consumer Rights Protection.

On the other hand, develop a Government Decree amending and supplementing a number of articles of Decree No. 98/2020/ND-CP dated August 26, 2020 of the Government regulating administrative sanctions for violations in commercial activities, production, trade of counterfeit and prohibited goods and protection of consumer rights and Decree No. 17/2022/ND-CP dated January 31, 2022 of the Government; develop a Decision of the Prime Minister promulgating the List of products, goods and services subject to registration of standard contracts and general transaction conditions.

In addition, develop and implement national projects, plans, programs and activities on consumer rights protection; urge the promulgation of regulations on coordination of state management on consumer rights protection at the local level; review and summarize the implementation of Decision No. 1157/QD-TTg dated July 12, 2021 of the Prime Minister on approving the Program for developing consumer rights protection activities for the period 2021-2025.

The Ministry of Industry and Trade also noted the organization of development, promulgation or submission to competent authorities for promulgation and implementation of national programs on consumer rights protection. Along with that are other national projects, plans, programs and activities on consumer rights protection as prescribed in Clause 1, Article 75 of the Law on Consumer Rights Protection.

Guide and urge the provincial People's Committees to promptly develop and promulgate regulations on coordination of state management on consumer rights protection among relevant state agencies at the local level as prescribed in Point b, Clause 1, Article 77 of the Law on Consumer Rights Protection to ensure the implementation of this Law is synchronous, unified and effective at the local level.

According to the Ministry of Industry and Trade, the National Competition Commission is responsible for presiding over and coordinating with relevant units to organize the implementation of the Plan; guiding and urging relevant units within the Ministry to implement and promptly report to the Minister to remove difficulties and obstacles.
