Notable policies taking effect in November

Several new legal policies will be put into effect in November, such as regulations on standards and norms for using public vehicles, a 30% reduction in land rent, and information about the police sector published online.

Next November, a number of new legal policies will be put into effect; notably, the Prime Minister's decision to reduce land rent in 2023 is worth mentioning.

New regulations on standards and norms for using public vehicles

From November 10, 2023, Decree No. 72/2023/ND-CP regulating standards and norms for automobile use will come into effect.

Positions that are allowed to regularly use a car, even after retirement, without a specified price include: General Secretary, President, Prime Minister, and Chairman of the National Assembly.

Positions that are allowed to regularly use a car during their working time, without a specified price, include the Standing member of the Secretariat, Politburo member, Secretariat member, Chairman of the Central Committee of the Vietnam Fatherland Front, Chief Justice of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy, Vice President, Deputy Prime Minister, and Vice Chairman of the National Assembly.

For positions that are allowed to regularly use an official car during work, Decree No. 72/2023/ND-CP is divided into 3 levels with 3 car purchase prices of 1.5 billion VND, 1.55 billion VND and 1.6 billion VND/car.

30% reduction in land rent in 2023

According to Decision 25/2023/QD-TTg of the Prime Minister on reducing land rent for 2023, reduce 30% of land rent payable (revenue) for 2023 for land lessees as prescribed above; do not reduce the outstanding land rent of years before 2023 and late payment fees (if any).

The above land rent reduction is calculated on the land rent payable (revenue generated) in 2023 according to the provisions of law.

In case the land lessee is receiving a reduction in land rent according to regulations or/and deductions for compensation and site clearance according to regulations of law on land rent, the 30% reduction in land rent is calculated on the amount of land rent payable (if any) after being reduced or/and deducted according to regulations of law (except for the amount of land rent reduced according to Decision No. 01/2023/QD-TTg dated January 31, 2023 of the Prime Minister).

This Decision comes into force from November 20, 2023.

Delegation of authority to stop ship-breaking facilities to Vietnam Maritime Administration

Decree No. 74/2023/ND-CP amending and supplementing a number of articles of Decree No. 82/2019/ND-CP dated November 12, 2019 of the Government regulating the import and dismantling of used ships, effective from November 27, 2023.

According to the decree, Article 11 is amended and supplemented to decide to immediately stop the operation of ship dismantling facilities.

Specifically, the Vietnam Maritime Administration decides to immediately stop the operation of the facility in case the ship dismantling facility causes an accident or incident with serious consequences for people and the environment based on the request of a competent state agency.

Based on the proposal and recommendation of the competent State agency, within 1 working day from the date of receipt of the request, the Vietnam Maritime Administration shall consider and decide to stop the operation of the ship dismantling facility.

The Vietnam Maritime Administration shall notify relevant agencies and publish the decision to immediately stop the operation of the ship-breaking facility on the Vietnam Maritime Administration's electronic information portal.

The Decree also amends and supplements Article 12 on the decision to stop the operation of ship dismantling facilities.

Specifically, the Vietnam Maritime Administration decides to suspend the operation of ship-breaking facilities in the following cases based on the request of competent state agencies: ship-breaking facilities do not meet operating conditions; for reasons of ensuring national defense and security; when there are epidemics, natural disasters, catastrophes and other cases as prescribed by law.

Based on the proposal and recommendation of the competent State agency, within 5 working days from the date of receipt of the request, the Vietnam Maritime Administration shall consider and decide to stop the operation of the ship dismantling facility; in case the operation of the used ship dismantling facility is not stopped, the Vietnam Maritime Administration shall have a written response stating the reasons.

The Vietnam Maritime Administration shall notify relevant agencies and publish the decision to stop the operation of the ship-breaking facility on the Vietnam Maritime Administration's electronic information portal.

Thus, the authority to decide to immediately stop or suspend the operation of ship dismantling facilities is assigned to the Vietnam Maritime Administration instead of the Ministry of Transport as per the old regulations.

Specialized information: crime warnings; instructions on reporting crimes; building a mass movement to protect national security; building laws; advanced models, beautiful images, good people, good deeds, bravery of police officers and soldiers and other propaganda topics.

Information on online public services being implemented by the Ministry of Public Security; other information decided by the leaders of the Ministry of Public Security or the Chief of Office of the Ministry of Public Security.
