Outstanding policies taking effect in October 2023

Some new legal policies will be put into effect, such as abolishing many Circulars on recruitment, promotion of civil servants, and credit policies for people who have completed their prison sentences.

Cars imported into Vietnam

In October 2023, a number of new legal policies will be put into effect. Notably, many circulars on recruitment and promotion of civil servants will be abolished; a number of circulars guiding the positions of civil servants and public employees; and credit policies for people who have completed their prison sentences.

Checking the technical safety and environmental protection quality of imported cars

The Government has issued Decree 60/2023/ND-CP regulating the inspection and certification of technical safety and environmental protection quality of imported automobiles and imported components according to international treaties to which Vietnam is a member.

The Decree stipulates that cars subject to recall include: Cars recalled according to the manufacturer's announcement; cars recalled according to the request of the inspection agency.

The request for recall by the inspection agency is made on the basis of specific evidence and verification results of information reflecting the technical safety and environmental protection quality of imported cars.

In case cars that have been put on the market have technical errors and need to be recalled, the importer must perform the following tasks:

Within no more than 5 working days from the date of receipt of the recall notice from the manufacturer or from the inspection agency, the importer must notify in writing the sales agents to request not to sell on the market the recalled cars that have not been repaired.

Within no more than 10 working days from the date of receipt of the recall notice from the manufacturer or the inspection agency, the importer must send to the inspection agency a written report with the following contents: cause of the technical error; remedial measures; number of cars to be recalled; appropriate recall plan; proactively implement and comply with the recall plan. At the same time, the importer must promptly and fully publish information about the recall plan and the list of cars to be recalled on the importer's website and sales agents.

Decree 60/2023/ND-CP takes effect from October 1, 2023, applicable to automobiles from August 1, 2025.

People who have completed their prison sentences will be eligible for preferential loans.

The Prime Minister has issued Decision No. 22/2023/QD-TTg regulating credit policies for people who have completed their prison sentences, production and business establishments employing people who have completed their prison sentences are allowed to borrow capital from the Social Policy Bank for vocational training, production, business and job creation. This Decision takes effect from October 10, 2023.

People who have completed their prison sentence and returned to their hometown can borrow capital for a maximum of 5 years.

According to Colonel Nguyen Van Long, Deputy Director, Deputy Head of the Criminal Enforcement Agency of the Ministry of Public Security, the newly issued policy has some notable points such as: People who have completed their prison sentences and returned to their localities to the time of being eligible for a loan of up to 5 years, have complied with the provisions of the law, have not participated in social evils and have a need to borrow capital will be listed by the Commune Police, confirmed by the People's Committee at the same level and sent to the Social Policy Bank to carry out loan procedures with preferential interest rates as for poor households. If borrowing for vocational training, the maximum is 4 million VND/month/person; if borrowing for production and business, the maximum is 100 million VND/person.

Production and business establishments that employ at least 10% of their total workforce who have completed their prison sentences and have a need and a loan plan confirmed by the People's Committee at the commune level may borrow a maximum of VND 2 billion/project and no more than VND 100 million/employee at the production and business establishment.

The Prime Minister's Decision specifically stipulates two types of subjects eligible for loans: Individuals who have completed their prison sentences and production and business establishments that employ people who have completed their prison sentences.

Abolishing a number of Circulars regulating the recruitment of civil servants, public employees, and promotion of civil servants

Circular 12/2023/TT-BNV abolishes a number of Circulars regulating the recruitment of civil servants and public employees, promotion of civil servants, promotion of public employees and implementation of contract regimes for certain types of work in state administrative agencies and public service units, effective from October 1, 2023.

Accordingly, 10 Circulars on recruitment of civil servants and public employees are abolished, including: Circular 13/2010/TT-BNV guiding the recruitment and promotion of civil servants of Decree 24/2010/ND-CP regulating the recruitment, use and management of civil servants.

Circular 05/2012/TT-BNV amends Circular 13/2010/TT-BNV guiding the recruitment and promotion of civil servants of Decree 24/2010/ND-CP regulating the recruitment, use and management of civil servants.

Circular 06/2013/TT-BNV abolishes Article 19 of Circular 13/2010/TT-BNV guiding on recruitment and promotion of civil servants of Decree 24/2010/ND-CP regulating recruitment, use and management of civil servants.

Circular 15/2001/TT-BTCCBCP guiding Decree 68/2000/ND-CP on implementing the contract regime for certain types of work in state administrative agencies and public service units.

Circular 03/2019/TT-BNV amends regulations on recruitment of civil servants and public employees, promotion of civil servant ranks, promotion of professional titles of public employees and implementation of contract regime for certain types of work in state administrative agencies and public service units.
