Many new policies take effect from December 2023

In December 2023, many new policies will take effect, such as transactions of VND 400 million or more must be reported to the State Bank, the fee for issuing driver's licenses online, etc.

Transactions of 400 million VND or more must be reported to the State Bank.

From December 1, 2023, Decision 11/2023/QD-TTg officially takes effect. This Decision stipulates that large value transactions must be reported to the State Bank of Vietnam according to the provisions of Clause 2, Article 25 of the Law on Anti-Money Laundering.

The subjects of application are financial institutions, organizations and individuals doing business in related non-financial sectors as prescribed in Clause 1 and Clause 2, Article 4 of the Law on Anti-Money Laundering.

Accordingly, transactions with a value of 400 million VND or more must be reported to the State Bank of Vietnam. Currently, the value of large-value transactions that must be reported to the State Bank of Vietnam is 300 million VND.

New regulations on fees for online driving license issuance

On October 16, 2023, the Minister of Finance issued Circular 63/2023/TT-BTC amending and supplementing a number of articles of circulars regulating fees and charges to encourage the use of online public services. The Circular takes effect from December 1, 2023.

Notably, the fee for organizations and individuals submitting applications for new issuance, re-issuance, and exchange of driving licenses (national and international) online from December 1, 2023 to December 31, 2025 will be VND 115,000/issuance.

From January 1, 2026 onwards, the fee collection rates specified in the Fee and Charge Rate Schedule issued with Circular 37/2023/TT-BTC will apply.

"Untangling the bottleneck" in health insurance payment

Decree 75/2023/ND-CP of the Government will take effect from December 3, 2023. This Decree amends and supplements a number of articles of Decree 146 dated October 17, 2018 of the Government detailing and guiding the implementation of a number of articles of the Law on Health Insurance (HI).

The Decree removes the "bottlenecks" in the payment mechanism for health insurance medical examination and treatment costs to facilitate health insurance medical examination and treatment, ensuring the rights of health insurance participants.

Accordingly, the subjects who are people in safe zone communes and revolutionary safe zones during the resistance war against France and the US, who are not subject to the provisions of Clauses 1, 2 and 3, Article 12 of the Law on Health Insurance, have been added to the group of subjects whose health insurance is paid by the state budget.

Supplementing the target group of ethnic minorities living in communes in region II, region III, and extremely disadvantaged villages in ethnic minority and mountainous areas in the period 2016-2020...

Increase the benefit level from 80% to 100% of the cost of medical examination and treatment under health insurance for a number of groups of people who have contributed to the revolution as prescribed in Clause 5, Article 3 of Decree No. 146/2018/ND-CP such as youth volunteers; police officers and soldiers who have been granted benefits according to the provisions of the Prime Minister's decisions; frontline workers.

Victims of domestic violence will be supported with medical expenses.

To detail the Law on Domestic Violence Prevention and Control 2022, the Government issued Decree 76/2023/ND-CP which will take effect from December 25, 2023.

Accordingly, Article 38 of Decree 76/2023/ND-CP stipulates the level of support for victims of domestic violence, including the following amounts:

Psychological counseling, providing skills to deal with domestic violence: according to the decision of the Provincial People's Committee; supporting essential needs when implementing contact prohibition: expenditure level as for social protection subjects.

Pay for medical examination and treatment costs if the victim of domestic violence whose health is damaged is cared for and treated at a medical examination and treatment facility.

Amending National Technical Regulations on Fire Safety for Houses and Constructions

Circular 09/2023/TT-BXD amending 1:2023 QCVN 06:2022/BXD National technical regulation on fire safety for houses and constructions takes effect from December 1, 2023.

For construction design documents that have completed fire prevention and fighting design approval by competent state management agencies, before December 1, 2023, they will continue to be implemented according to the approved design documents.

Construction design documents that have received written comments on fire prevention and fighting design at the basic design step from the competent state management agency, but have not yet been approved for fire prevention and fighting design, before December 1, 2023, will continue to be reviewed and approved according to written comments.

Construction design documents that have not been commented on and approved for fire prevention and fighting design by competent state management agencies since December 1, 2023 must comply with the provisions of QCVN 06:2022/BXD and Amendment 1:2023 QCVN 06:2022/BXD.
