Borrowing someone else's car and being fined for not owning the car is a matter of great concern and below is some information to answer it.

Currently, there is no regulation that defines what a non-owner vehicle is. However, according to the law, based on Point a, Clause 4; Point l, Clause 7, Article 30 of Decree 100/2019/ND-CP, the error of "non-owner" is that the vehicle owner does not complete the registration procedure at the competent state agency when buying; being given or being gifted.

The reason why people do not comply with this regulation often comes from the complicated name change procedure along with the fees that must be paid; Moreover, most of the vehicles that are not transferred are usually low-value motorbikes. Therefore, people do not take this procedure seriously until they are punished.

Thus, the act of not registering a vehicle to change the owner's name in the vehicle registration certificate when purchasing, being given, being gifted, being allocated, being transferred, or being inherited is a violation.

According to Decree 100/2019/ND-CP; the act of not completing the vehicle registration procedure has different fines. Depending on the type of unregistered vehicle:

Individual violators will be fined from 400,000 - 600,000 VND.

For violating organizations will be fined from 800,000 VND - 1.2 million VND.

For not registering car ownership transfer procedures.

Individual violators will be fined from 2 to 4 million VND.

For violating organizations will be fined from 4 to 8 million VND.

The regulations are specified as follows:

"Article 30. Penalties for vehicle owners violating regulations related to road traffic...

4. Fine from 400,000 VND to 600,000 VND for individuals, from 800,000 VND to 1,200,000 VND for organizations that are owners of motorbikes, mopeds and similar vehicles that commit one of the following violations:

a) Not completing the vehicle registration procedure (to transfer the vehicle owner's name in the Vehicle Registration Certificate to one's own name) as prescribed when purchasing, being given, being gifted; being allocated, being transferred; inheriting assets such as motorbikes, motorbikes, and vehicles similar to motorbikes;...

7. Fine from 2,000,000 VND to 4,000,000 VND for individuals; from 4,000,000 VND to 8,000,000 VND for organizations that are owners of cars, tractors; specialized motorbikes and vehicles similar to cars that commit one of the following violations:…

l) Failure to carry out vehicle registration procedures (to transfer the vehicle owner's name in the Vehicle Registration Certificate to one's own name) as prescribed when purchasing, being given, being gifted, being allocated, being transferred, or inheriting assets such as automobiles, tractors, specialized motorbikes, or vehicles similar to automobiles;"

In the case of a child borrowing a car from his father, a wife borrowing a car from her husband, or borrowing someone else's car, will they be punished for not being the owner? There are no regulations to punish people who borrow cars. In a family, it is completely normal for husbands, wives, children, and siblings to ride each other's cars, as long as they have the registration.

However, vehicles that are not registered in the owner's name will be penalized in two cases: When registering and inspecting the vehicle, the authorities discover that the vehicle has exceeded the transfer period (regulations require that the vehicle's name be changed after 30 days of purchase and sale). If the vehicle is not registered after 30 days, the owner will be penalized for not changing the name.

Second, when a collision or traffic accident occurs, the vehicle owner must come and resolve it. If the vehicle is not owned by the owner, a fine will be imposed.
