On the afternoon of May 17, the Ministry of Education and Training held a discussion to collect opinions from press agencies on the draft Law on Teachers. The issue of teachers' salaries and professional certificates for teachers was raised by many journalists at the discussion.
Standardize the teaching staff
Deputy Minister of Education and Training Pham Ngoc Thuong said that this is the first discussion between the Ministry of Education and Training and the press on the draft Law on Teachers. The draft Law on Teachers has been publicly posted on the Government Portal and the Ministry of Education and Training to receive comments from all walks of life and agencies and organizations; in which the press plays an important role in orienting the communication of the core issues of the draft law.
The Ministry of Education and Training said that many laws on education have been issued, but a law for teachers has been a desire and plan for decades.
The education sector considers developing the teaching force as one of the key and breakthrough solutions. Therefore, the Ministry of Education and Training has advised the Government to propose the development of the Law on Teachers.
The Draft Law on Teachers, which was approved by the Government and included in the law and ordinance making program by the National Assembly, has become a breakthrough and brought great encouragement to millions of teachers nationwide.
On May 13, 2024, the Ministry of Education and Training announced the Draft Law on Teachers to widely collect public opinions.
Mr. Vu Minh Duc, Director of the Department of Teachers and Educational Managers, Ministry of Education and Training, said that there are 5 policies and 6 notable points in the draft Law on Teachers.
Specifically, 5 policies have been designed in the Draft Law on Teachers, including: Identification of teachers; standards and titles of teachers; recruitment, use and working regime of teachers; training, fostering, treatment and honoring of teachers; State management of teachers.
Accordingly, Mr. Duc affirmed that the draft Law on Teachers ensures that teachers' salaries are ranked highest in the administrative career salary scale system; ensuring equality between public and non-public teachers.
According to the new salary construction rules, the basic salary accounts for 70%, and the preferential allowance accounts for 30%. The education sector will enjoy the highest level of preferential allowance according to the profession. According to the regulations, the new salary must not be lower than the old salary. In case it is lower, teachers will be allowed to keep the old salary.

Regarding salary and benefits policies for teachers, the draft Law proposes sanctions to ensure that salaries and salary policies for teachers working at non-public, private, and autonomous educational institutions must be no less than those of teachers with the same training level, seniority, and title in public educational institutions receiving salaries from the State budget.
In addition, the Law on Teachers is expected to adjust regulations on teacher management towards unifying State management of teachers in the entire system, while strengthening decentralization, affirming the position and role of State management of the Education sector (especially for preschool and general education levels) to resolve shortcomings in local surplus/shortage of teachers, proactively regulating teachers in each province/nationwide...
A practicing certificate is required.
One of the provisions stated in the draft Law on Teachers is the provision on the Certificate of Practice for Teachers. The Certificate of Practice for Teachers is a document confirming the qualifications of a teacher issued by a competent authority of Vietnam to a person who meets the standards for the title of teacher according to regulations.
The Ministry of Education and Training said that through studying international experience and experience from a number of industries/fields, the Drafting Committee proposed and expected that the basic practice certificate would have a positive impact on teachers and educational institutions.
In order to avoid disruption when applying regulations on professional practice certificates, the draft Law on Teachers has calculated a favorable transition plan for 1.6 million teachers who were recruited into the industry before the Law took effect to be granted professional practice certificates without the need for assessment and testing.
Retired teachers who wish to do so can also be granted a practice certificate to recognize their dedication to education or to continue their professional activities.
The Draft Law on Teachers fully and clearly identifies teachers at all levels of education and training, in regular education institutions, specialized schools, university preparatory schools and other educational institutions.
Along with the identification of teachers, the Law on Teachers specifically describes the professional activities of teachers, prescribes teacher standards for unified use, and is associated with each teacher title.
This is the first time that the identification of teachers associated with the characteristics of the profession has been fully and systematically regulated, serving as a basis for standardizing and proposing regulations and policies for teachers. This both ensures the quality of the teaching staff and creates equality between teachers in public and private educational institutions.
The Director of the Department of Teachers said that there are people who do not work in educational institutions and only teach online and will be granted a license if they need it.
It is known that during the drafting process, the drafting committee mentioned this issue. However, these subjects operate quickly and complexly, especially online training. Therefore, the drafting committee will propose a pilot implementation of the management of some of these subjects, on that basis, it will continue to edit and supplement.
Mr. Vu Minh Duc affirmed: "This practice certificate helps to enhance the status and role of teachers, to distinguish those who are qualified to teach from those who are not qualified to teach but claim to be teachers online."
This certificate of practice will also facilitate teachers if there are changes in their workplace because it is valid nationwide. Therefore, no matter where teachers teach, they do not need to re-implement the internship regime, reducing procedures when transferring and signing work contracts...
