Failure to register for tutoring business will result in a fine of up to 100 million VND

Not only in Hai Duong, in reality, many freelance teachers, teachers of non-public schools, teachers of public schools organize extra teaching outside of school. From there, negative phenomena in extra teaching and learning appear. Therefore, Circular 29/2024/TT-BGDDT dated December 30, 2024 of the Ministry of Education and Training has The regulations are very specific and clear for educational institutions and teachers to implement, and are in line with the spirit of only prohibiting negative phenomena in extra teaching and learning, not prohibiting the legitimate needs of both teachers and students.

Circular 29 also stipulates that from February 14, extra classes will not be allowed in schools, except for certain specific groups. Thus, the need for extra classes for students outside of school will be very large.

According to this circular, organizations or individuals organizing extra-curricular teaching and learning activities outside of school with fees from students from February 14, 2025 must register their business according to regulations. Depending on the form and scale of extra-curricular teaching, they can choose to register to establish a business or register as a sole proprietorship.

Accordingly, in Hai Duong, a number of organizations and individuals have also registered their businesses related to the education sector at the Department of Planning and Investment. Many enterprises have added business lines related to the education sector to organize extra classes.

Thus, from February 14, if organizations or individuals conduct extra-curricular tutoring activities outside of school and collect money from students without registering their business, they will be fined from 5 million to 100 million VND.

Specifically, Decree 122/2021/ND-CP of the Government stipulates a fine of 5 - 10 million VND for individuals who do not register to establish a business household; 10 - 20 million VND for organizations in cases where registration is required according to regulations.

The above fines will also apply to the following acts: individuals and household members registering more than one business household; not being entitled to establish a business household but still establishing a business household; not registering changes to the contents of the business household registration certificate with the district-level business registration agency within 10 days from the date of change.

Decree 122 stipulates a fine of 50 - 100 million VND for doing business in the form of an enterprise without registration; continuing to do business after having had its business registration certificate revoked or being requested by a competent state agency to temporarily stop doing business, suspend operations, or terminate business...
