Beating people over dispute over selling space at Red Star Square

On the evening of July 5, 2023, Toi and Minh went to Sao Do Square, Sao Do Ward (Chi Linh City) to find a sales position for Ms. Dong Thi Thao (born in 1998, residing in Van Duc Ward, Chi Linh City), Toi's niece.

Seeing that there was still an empty space near the stage (this position had been approved by Chi Linh Transport, Environment and Urban Joint Stock Company for Mr. Pham Phi Hung, born in 1994, residing in Sao Do Ward to do business), Minh called Mr. Nguyen Quang Dai, Deputy Captain of the Urban Order Management Team of Chi Linh City to ask for a sales position for Ms. Thao. Because Mr. Dai did not have the authority, he told Minh to ask again to see if anyone had hired a salesperson for that position. But Minh thought Mr. Dai had agreed, so he told Toi that he had asked for this position to sell goods.

At 7:45 p.m. on July 6, 2023, Toi and Minh were having dinner when Thao called Toi to say that the location at Sao Do Square that Toi had asked for her was now available for sale. After hearing Thao's words, Toi and Minh went to the square.

When Toi and Minh arrived, they saw two young men setting up tables and chairs to sell their goods. Toi asked, “Are you the owner? Are you related to this peach tea cart?” One of them replied, “I’m just an employee of the shop.” Toi patted the two young men on the head and cursed with Minh, “Will you guys clean it all up? This is my place.” Out of fear, the two young men packed up their tables, chairs, and signs and went inside, no longer selling anything.

About 5 minutes later, Mr. Nguyen Duy Thuc, a security guard of Chi Linh Transport, Environment and Urban Joint Stock Company, whose duty is to protect public order in Sao Do Square, arrived at the cafe. When he arrived, Mr. Thuc told Toi and Minh: "This cafe belongs to Hung." Seeing that, Toi and Minh punched Mr. Thuc in the head and face. Then Toi continued to hit Mr. Thuc with his helmet, Minh slapped him in the face, causing injuries to Mr. Thuc's face and head.

Toi and Minh beat Mr. Thuc until someone intervened. Mr. Thuc went to Sao Do Ward Police to report the incident. About 2 minutes later, Mr. Hung arrived, Minh said to Mr. Hung: "What are you doing here, what are you looking at?", while holding a phone in his right hand, he hit Mr. Hung's left cheek. When people intervened, Minh stopped, but Minh and Toi continued to curse, and left at 8:20 p.m. the same day.

Mr. Thuc suffered 3% physical injury from being beaten by Toi and Minh. The two subjects came to curse and use weapons to beat people at Sao Do Square, a public place and densely populated area, which negatively affected public security and order in Sao Do Ward (Chi Linh City), causing panic and fear among the masses.

Dong Van Toi and Mac Van Minh both have bad personal records. Toi has been imprisoned twice for illegal drug trafficking, illegal trading and possession of military weapons, and has been administratively punished once for causing injury. Minh has been imprisoned three times for intentional injury, and has been administratively punished five times for intentionally causing injury or harming the health of others but has not been prosecuted, illegally using drugs, and harming the health of others.

The jury sentenced Dong Van Toi to 37 months in prison and Mac Van Minh to 42 months in prison, both for disturbing public order.
