According to the Ministry of Public Security, attaching electronic monitoring devices to people who are prohibited from leaving their place of residence will help prevent these subjects from escaping or continuing to commit crimes.

The Ministry of Public Security has just submitted a draft proposal to develop a Law on Temporary Detention, Temporary Imprisonment and Prohibition from Leaving Place of Residence to solicit comments from agencies, organizations and individuals. This is a draft law amended from the current Law on Temporary Detention and Temporary Imprisonment.

According to the Ministry of Public Security, the 2015 Criminal Procedure Code clearly states that prohibiting leaving the place of residence is a preventive measure that can be applied to suspects and defendants with a clear place of residence and background to ensure their presence upon summons from the investigation agency, the prosecutor's office, and the court.

Suspects and defendants who are prohibited from leaving their place of residence must make a written commitment to fulfill prescribed obligations, including the obligation to be under the management and supervision of commune-level authorities or military units.

However, the practical implementation of the regulation on the measure of prohibiting leaving the place of residence still has some shortcomings such as the lack of procedures for implementing this measure since the competent authorities issued the order prohibiting leaving the place of residence.

Prohibition from leaving the place of residence is a preventive measure that can be applied to suspects and defendants with a clear place of residence and background.

Due to the lack of application of science and technology, the authorities do not know where the subjects subject to the measure of not leaving the place of residence are going, what they are doing to apply monitoring and management measures. In practice, there have been cases where subjects subject to the measure of not leaving the place of residence have escaped, leading to the competent authorities having to issue wanted notices.

To overcome difficulties and obstacles in the practical implementation of the measure of prohibiting people from leaving their place of residence, the Ministry of Public Security proposed choosing the solution of attaching an electronic monitoring bracelet (a bracelet or ankle bracelet) to people prohibited from leaving their place of residence.

Applying electronic monitoring measures will prevent people subject to homelessness measures from escaping or continuing to commit crimes; and resolve the absence from their place of residence of people subject to homelessness measures.

This also helps to track the movement of objects, remotely identify and track the location of that person. An integrated system to monitor unauthorized tracking and opening of devices is also built.

The Ministry of Public Security informed about the experience of some countries in the world, some countries have used bracelet devices to manage people serving criminal sentences in the community such as Japan, China, Thailand...

According to the Department of Prisons and Parole - Ministry of Justice of the Kingdom of Thailand, after 3 years of pilot implementation, the number of violators was very low, it was assessed as highly effective, reducing costs compared to managing subjects in prison.

The Ministry of Public Security said the state budget will cover the purchase of surveillance equipment, the construction of an electronic surveillance management center, and the maintenance of related equipment.
