On the roads in our country there are currently regulations on maximum speed, if the driver exceeds the speed they will be fined.
Driving cars and motorbikes at a speed exceeding the prescribed speed limit is strictly prohibited under the 2008 Road Traffic Law. Violations of speeding may result in penalties under Decree 100/2019/ND-CP.
When is it illegal to drive over the speed limit without being fined?
However, there are still cases of drivers driving cars and motorbikes exceeding the speed limit but not being punished by traffic police.
Specifically, at Point a, Clause 3, Article 5, Point c, Clause 2, Article 6 of Decree 100/2019/ND-CP, only car and motorbike drivers who exceed the prescribed speed limit by 5 km/h or more will be fined.
“Article 5. Penalties for drivers of automobiles and similar vehicles violating road traffic rules.
3. A fine of VND 800,000 to VND 1,000,000 shall be imposed on a driver who commits one of the following violations:
a) Driving a vehicle at a speed exceeding the prescribed speed limit by 5 km/h to less than 10 km/h”.
Article 6. Penalties for drivers of motorbikes, mopeds (including electric motorbikes), vehicles similar to motorbikes and vehicles similar to motorbikes who violate road traffic rules.
2. A fine of 300,000 VND to 400,000 VND shall be imposed on a driver who commits one of the following violations:
c) Driving a vehicle at a speed exceeding the prescribed speed limit by 5 km/h to less than 10 km/h”.
Thus, if a driver of a car or motorbike exceeds the speed limit by less than 5km/h, he/she will not be fined but instead will be warned by the traffic police.
For example, on a road with a maximum speed limit of 40 km/h, driving at 44 km/h will not result in a fine.
