On the afternoon of October 22, discussing at Dien Hong hall, delegate Nguyen Thi Viet Nga, Deputy Head of the National Assembly Delegation (NAD) of Hai Duong province, commented on 4 remaining issues in the draft Law on implementing democracy at the grassroots level.

Firstly, regarding the establishment and operation of the People's Inspection Committee (PCC), this Committee is regulated to be established in communes, wards, towns, agencies, units and other labor-using organizations. Considering the functions and tasks of the Committee, delegate Nguyen Thi Viet Nga said that expanding the scope of units and organizations that must be established has positive aspects, contributing to improving the implementation of democracy at the grassroots level, ensuring the rights of the people. However, many agencies and organizations do not establish PCCs according to the provisions of the 2010 Inspection Law or have established them but operate in a formal manner.

"To ensure that agencies, units and organizations establish and maintain the operation of the BTTND in accordance with regulations and promote the functions, responsibilities and powers of the Board, it is necessary to stipulate mechanisms and sanctions for units and organizations to comply with. At the same time, it is necessary to overcome the current situation where many agencies and organizations do not have a BTTND according to the provisions of the 2010 Law on Inspection, especially when the draft has expanded the scope of establishing the BTTND to organizations using non-state labor," delegate Nguyen Thi Viet Nga said at the meeting hall.

Regarding operating costs, the draft Law stipulates that the operating costs of the People's Councils are supported by the Vietnam Fatherland Front Committees of communes, wards and towns and the executive boards of trade unions. However, the operating costs of the People's Councils at the grassroots level are mostly limited, so it is necessary to stipulate the minimum amount of funding that must be allocated to the People's Councils of communes, wards and towns and the percentage of funding allocated for the activities of the People's Councils in the total budget of the grassroots trade unions.

Regarding the term of office, the delegate proposed that the term of office of the People's Council at the employing organization should be revised to be similar to the regulation on the term of office of the People's Council at the commune, ward, and town level according to the term of office of the village chief and the head of the residential group in the same locality. Accordingly, the term of office of the People's Council at the employing agency, unit, or organization should be revised to be the same as the term of office of the grassroots trade union executive board.

Regarding the regulation on household representatives attending village and residential group meetings, the draft clearly states that “a household representative is a person with full civil act capacity, capable of representing household members; in case a household does not have a person with full civil act capacity, the household representative is a person unanimously nominated or authorized by the household members”. However, in case a household does not have a person with full civil act capacity, the members of that household cannot have enough capacity to unanimously nominate or authorize a household representative. Even if an agreement is reached, such agreement does not ensure voluntariness because the members are not in a state of full awareness. Delegate Nguyen Thi Viet Nga suggested that the drafting committee consider amending this regulation.
