Ms. Truong My Lan said that at all costs she will pay the State Bank the special loan given to SCB to maintain operations.
On the afternoon of November 8, the lawyers continued to question Ms. Truong My Lan, representative of SCB, and a number of defendants about issues related to handling seized assets and remedying the consequences of the case.
Responding to the questioning of lawyer Giang Hong Thanh (one of the five defense lawyers), Ms. Lan said that since the first instance trial until now, the family has paid a total of 500 billion VND.
Regarding the VND5,000 billion increase in charter capital for SCB, paid at SHB bank, Ms. Lan said it was money transferred by a friend through Vietcombank and by a foreign investor.
"Two months before I was arrested, I still determined that this amount of money had not been recorded. All the money generated profits. I hope SCB sympathizes and immediately transfers that amount to remedy the consequences," said Ms. Lan.
Next, Ms. Lan asked the court to review and recalculate the amount of money she was accused of embezzling. However, no matter how much compensation she was forced to pay, she still pledged to use all of her assets (about 1,800 assets) to repay the money that the State Bank had lent SCB specifically to maintain its operations, after the incident occurred.
She also asked the State to provide legal support for unfinished projects and she herself will be responsible for calling for foreign investors to develop the projects.
"If the handling of 1,121 collateral codes is not enough, the defendant commits to using 658 assets that have not been mortgaged for any loan to resolve the case such as Ba Son Saigon Port, Amigo, and some assets that SCB is borrowing. The defendant only asks for the real estate properties that are the headquarters of Van Thinh Phat. At all costs, the defendant will pay the State Bank in full," Ms. Lan stated.
The defendant agreed with the data of lawyer Thanh, that 681 asset codes (out of 1,121 assets securing loans at SCB) were valued by Hoang Quan Company at about VND 236,510 billion, which was too low, possibly causing her to lose more than VND 193,000 billion. Therefore, she requested a re-evaluation, including the Red Cape project.
Ms. Lan gave an example, a project in District 2 that she and her friends transferred 120,000 billion VND in 2022, the "Red Cape" project must be doubled. This project was under construction, implementing many items when she was arrested.
In addition, among the 440 unpriced assets and considered to have a value of zero, there are many properties with very large values such as: 2-4-6 Hai Ba Trung, District 1; 156 Tran Phu, District 10; 196-202 Nam Ky Khoi Nghia, District 3 (Grand Center project)...
According to the lawyer, 6 years ago this land plot at 2-4-6 Hai Ba Trung was valued at 3,000 billion VND, but according to Ms. Lan, the actual value is "much larger".
The defendant also agreed to use the amount of more than 6,095 billion VND that the two companies of "Lord of Tuan Chau Island" returned; 1,200 billion VND of Phuong Trang Company; 2,355 billion VND of Hong Phat Company and 2,882 billion VND of Quoc Cuong Gia Lai to pay back to remedy the consequences of the case.
The Chairman of Van Thinh Phat also requested the enforcement agency to re-evaluate his assets and apply the new land price list issued by the Ho Chi Minh City People's Committee on October 22. At the same time, he requested that this agency supervise the process of SCB handling the assets that are being seized and handed over to the bank for handling.
CEO of Tuong Viet Company paid enough cash to remedy the consequences
After questioning Ms. Lan, lawyer Nguyen Thi Huyen Trang said that among the 1,121 property codes securing loans at SCB, there were real estate at 24 Le Loi belonging to Truong Hue Van and 22 Le Loi belonging to Hue Van's brother, along with many properties of several other individuals used to secure loans of Tuong Viet Company (defendant Duong Tan Truoc) as General Director.
During the recent trial, the defendant Truoc's family has sought many sources of money to fulfill all civil obligations that must be performed.
When the lawyer asked for her opinion on returning these assets to the owners, Ms. Lan said: "If Mr. Truoc has paid, please separate these assets and return them to the owners, Truong Hue Van and her brother. As for the other assets that were lent to the defendant by friends to borrow money to restructure SCB, use them to remedy the consequences of other remaining obligations."
Regarding this loan, Duong Tan Truoc agreed to return the mortgaged assets to the previous owner who lent him money to mortgage to borrow money from SCB - in fact, Ms. Lan paid Truoc's debt in the form of a loan and Ms. Lan committed to pay SCB herself but did not do so. The defendant requested the Trial Panel to consider reducing his sentence because he had paid 100% of the money required to execute the judgment.
In the first phase of the case, Ms. Lan was determined to have caused losses of VND677,000 billion in principal and interest to SCB. In April, the Ho Chi Minh City People's Court sentenced Ms. Lan to death for violating regulations on lending in the operations of credit institutions, bribery, and embezzlement; forced to compensate all damages to SCB.
The appeal review session of Ms. Truong My Lan and 47 others has ended the questioning phase. On November 12, the trial continued with the debate phase.
