Strictly handle officers and soldiers of armed forces who violate regulations on alcohol concentration

On September 17, Prime Minister Pham Minh Chinh signed and issued Directive No. 35/CT-TTg on handling cadres, civil servants, public employees and soldiers in the armed forces who violate regulations on driving vehicles with alcohol concentration in their blood or breath; and do not cooperate with authorities in handling violations.

The Directive stated: In recent times, under the drastic and regular direction of the Secretariat, the Government, the Prime Minister, all levels, sectors, and socio-political organizations, the majority of cadres, party members, and people have had positive changes in their awareness of law compliance, culture, and behavior when participating in traffic, contributing to making traffic activities more civilized and safer.

However, there are still a number of cadres, civil servants, public employees, officers and soldiers in the armed forces (hereinafter referred to as cadres, civil servants and public employees) who are not exemplary, violate the law when participating in traffic, even have substandard behavior, do not comply with the inspection and handling of the functional forces, especially in the inspection of violations of driving vehicles with alcohol concentration in the blood or breath (violation of alcohol concentration); in some cases, driving vehicles violating alcohol concentration causing traffic accidents resulting in death, fleeing the scene, resisting and not cooperating with the inspection and handling of the functional agencies, causing public outrage. In 2023 and the first quarter of 2024 alone, the police force inspected, handled administrative violations and verified and sent notices to the management agencies and units for more than 7,600 party members, cadres, civil servants and public employees violating alcohol concentration.

The main cause of the above situation is that a number of cadres, civil servants and public employees lack self-cultivation and training, and do not fully understand their obligations and responsibilities in ensuring traffic order and safety; heads and leaders of some administrative agencies, public service units and units of the armed forces have not paid attention to thoroughly grasping and organizing the implementation of the directions of the Party, the Government and the Prime Minister in ensuring traffic order and safety; they have loosened discipline and order, lacked responsibility in managing cadres, covered up and failed to seriously and properly discipline cadres, civil servants and public employees who commit violations to rectify and remind the general public in the agency or unit. A number of traffic accidents were caused by cadres, civil servants, public employees and armed forces officers violating alcohol concentration, which affected the prestige and image of cadres, civil servants and public employees, causing discontent among the people.

It is strictly forbidden to cover up or conceal the shortcomings of officials.

The above situation requires further strengthening of management and rectification of law compliance when participating in traffic by cadres, civil servants and public employees, contributing to building ethical standards and behavioral culture of cadres, civil servants and public employees; therefore, the Prime Minister requests ministers, heads of ministerial-level agencies, heads of government agencies, Chairmen of People's Committees of provinces and centrally run cities: must determine that promoting the pioneering, exemplary and leading role of cadres in complying with traffic laws is very important to reshape the habit of law compliance, first of all traffic laws, as well as other provisions of law in the whole society.

When there is a notice from a competent authority about a cadre, civil servant or public employee under its management violating alcohol concentration and not cooperating with the competent authority in handling the violation, the cadre management agency, based on the provisions of the law on disciplinary action against cadres, civil servants and public employees and the specific regulations of the agency or unit, must strictly implement the handling procedure according to the regulations; the handling must ensure objectivity, fairness, publicity, strictness, accuracy, timeliness, proper authority, order and procedures, strictly prohibiting the covering up or concealment of shortcomings of the violating cadre, civil servant or public employee and periodically every year (before October 15) exchanging the results of disciplinary action with the agency sending the notice of violation for synthesis and reporting to the Prime Minister.

Consider the responsibility of the head, the head of the agency, the unit directly employing the cadres, civil servants, and public employees who have many people violating alcohol concentration, not complying with orders and requests of the law enforcement force, or not strictly or promptly handling cadres, civil servants, and public employees who have committed violations under their management authority.

Organize the serious implementation of this Directive; thoroughly educate all cadres, civil servants and public employees to be exemplary in complying with legal regulations on traffic order and safety and strictly discipline cadres, civil servants and public employees who violate alcohol concentration and do not cooperate with functional forces in handling violations in accordance with regulations.

No forbidden zones, no exceptions

The Prime Minister requested the Minister of Public Security to direct the Public Security of units and localities in the process of patrolling, inspecting and handling traffic law violations to comply with the spirit of "rule of law", "no forbidden zones, no exceptions", not accepting intervention or influence to ignore violations; strictly disciplining officials who do not thoroughly handle or ignore violations in the process of handling traffic administrative violations. The handling process must be verified, if the violator is an official, civil servant or public employee who violates the alcohol concentration when driving a vehicle and does not cooperate with the authorities in handling the violation, the agency or unit managing the official must be notified for consideration and handling in accordance with regulations.

In cases of driving vehicles violating traffic laws related to alcohol concentration causing traffic accidents, opposing behavior, disturbing public order, obstructing the performance of duties of functional forces, it is necessary to promptly consolidate records, investigate, coordinate with the Procuracy and Court to strictly handle according to the provisions of law.

The Minister of National Defense organizes the dissemination and rectification of the entire military on exemplary compliance with the provisions of the law when participating in traffic, especially not driving after consuming alcohol and complying with the inspection and handling of functional forces; coordinates with functional agencies of the Ministry of Public Security to investigate and strictly handle traffic accidents related to alcohol concentration caused by people and vehicles managed by the Army; reviews and strictly handles cases of soldiers, civil servants, workers and defense officials in the Army violating alcohol concentration and not cooperating with functional forces in handling violations.

The Minister of Home Affairs organizes information dissemination, dissemination, and monitoring of the situation of cadres, civil servants, and public employees violating alcohol concentration.

Pursuant to the provisions of the law on administrative discipline, guide agencies, organizations and units to strictly handle violations and handle the responsibilities of leaders according to regulations; at the same time, commend and reward typical cadres, civil servants and public employees who contribute to ensuring traffic safety.

Do not take advantage of prestige or work position to interfere in handling traffic violations.

Chairmen of People's Committees of provinces and centrally run cities shall issue documents specifying the tasks and solutions in this Directive in accordance with the characteristics of the situation, requirements and tasks in the locality, focusing on: Directing state administrative agencies, public service units, and armed forces units in the locality to thoroughly implement the directions of the Party, the Government, and the Prime Minister in ensuring traffic order and safety; strengthening the dissemination of the Party's guidelines, policies, and regulations, the State's policies and laws; honoring, responsibilities and requirements for pioneering and being exemplary in complying with traffic laws; at the same time, mobilizing friends and relatives to comply and not take advantage of their prestige and work positions to interfere in the handling of traffic violations by functional forces, especially violations of alcohol concentration. Strengthen inspection, examination and supervision, including supervision from the people, on the compliance with discipline and order when participating in traffic for cadres, civil servants and public employees in state administrative agencies, public service units and armed forces units.

The Central Committee of the Vietnam Fatherland Front and socio-political organizations shall strengthen propaganda and mobilize people, union members and association members to be active, voluntary and exemplary in complying with legal regulations on traffic order and safety and strictly discipline officials, union members and association members who violate alcohol concentration and do not cooperate with functional forces in handling violations; strengthen supervision by the Vietnam Fatherland Front and people's organizations, and supervision by the people on the compliance with discipline and order when participating in traffic for officials, civil servants and public employees.

The Supreme People's Procuracy and the Supreme People's Court direct the Procuracy and the Courts at all levels to coordinate with the Investigation Agency to strictly handle cases of cadres, civil servants and public employees violating alcohol concentration, causing serious accidents or having acts of opposition, disturbing public order, or obstructing the performance of duties of functional forces.

Press agencies and mass media should strongly promote their supervisory role, actively participate in detecting, giving opinions and criticizing to the public about traffic law violations by officials, civil servants and public employees, especially driving after consuming alcoholic beverages...
