Trial of 16 defendants

From January 6 to October 11, 2021, Pham Van Quyen (born in 1984, residing in Ngoc Chau ward, Hai Duong city) bought gas from Super gas LLC in Dinh Vu industrial park in Hai Phong city, Viet Hai Petroleum Trading LLC in Luong Dien commune (Cam Giang) and bought floating gas of unknown origin, without value-added invoices in the form of tank trucks.

Quyen rented a location to install a gas decanting system in Nhan Nghia residential area, Nam Dong ward (Hai Duong city); hired Pham Van Quang (born in 1965, residing in Thuc Khang commune, Binh Giang), Bui Van Li (born in 1984, residing in Thanh Khe commune, Thanh Ha), Pham Tien Hung (born in 1987, residing in Tan Binh ward, Hai Duong city) to decant gas cylinders of 12kg and 45kg. Quyen also sold gas cylinders with fake stamps and shrink-wrap to agents.

To sell gas to the market, Quyen hired Nguyen Minh Tien (born in 2000, residing in Quang Nghiep commune, Tu Ky), Pham Tien Hai (born in 1987, residing in Nhi Chau ward, Hai Duong city) and Pham Tien Hung to deliver gas cylinders with fake stamps and shrink-wrap seals for agents to self-seal and sell to the market. The total number of gas cylinders sold by Quyen to Hai and 9 agents in Hai Duong was 34,554 cylinders, worth more than 7.7 billion VND, equivalent to the real goods.

In addition, Quyen also transferred to agents who bought together a total of 1,248 gas cylinders of various types, equivalent to the quantity of genuine goods worth more than 443 million VND.
In this case, Quyen was the one who organized the decanting, bought fake stamps and shrink wrap, so he played the main role. Tien, Quang, Li, Hai, and Hung helped Quyen decant, deliver gas and shrink wrap to agents, so they played the role of accomplices in the case.

The defendants: Nguyen Thi Thuy (born in 1989, residing in An Son commune, Nam Sach), Pham Van Bien (born in 1982, residing in Thach Khoi ward, Hai Duong city), Tran Thi Loan (born in 1973, residing in Kim Lien commune, Kim Thanh), Vu Thi Kim Oanh (born in 1971, residing in Tan Phong commune, Ninh Giang), Vu Ba Thiet (born in 1960, residing in Chi Lang Nam commune, Thanh Mien), Truong Dinh Trong (born in 1979, residing in Thanh Quang commune, Nam Sach), Dam Van Chuan (born in 1983, residing in Nam Sach town), Pham Van Ngát (born in 1960, residing in Le Hong commune, Thanh Mien), Nguyen Van Kien (born in 1976, residing in Tu Cuong commune, Thanh Mien) are independently responsible for the act of producing and trading counterfeit goods.

Tran Van Hieu (born in 1987, residing in An Thuong commune, Hai Duong city) was the gas truck driver for Thuy and together with Thuy sealed the shrink wrap, so he was an accomplice with Thuy in the role of the executor.
The jury sentenced Pham Van Quyen to 7 years and 6 months in prison. Sentenced 9 other defendants from 33 months to 6 years in prison; 6 remaining defendants from 15 months in prison with suspended sentences to 35 months in prison with suspended sentences, all for the crime of manufacturing and trading in counterfeit goods.
