Temporarily suspend the trial of the internal conflict case of Hung Viet Company

Late in the afternoon of May 22, after 2 days of first-instance trial of a commercial case on “internal company dispute, compensation claim” between the parties related to Hung Viet Agricultural Products Joint Stock Company in Gia Tan Commune, Gia Loc District (abbreviated as Hung Viet Company), the Provincial People's Court issued a decision to temporarily suspend the trial. The decision clearly stated the reason for the need to verify and collect additional documents and evidence, which if not done, would not resolve the case and could not be done immediately at the trial.

The first instance civil trial is scheduled to continue at 8:00 a.m. on June 23, 2023 at the headquarters of the Provincial People's Court.

During the first-instance trial of the above case on May 19 and 22, the Trial Panel heard the parties present the content of the lawsuit, the request for compensation, the preliminary status of Hung Viet Company after the internal dispute until now... In the questioning session that took place during most of the two days of the trial, the disputing parties emphasized some information, documents, and content related to the case such as the legal basis for the status of members of the Board of Directors of Hung Viet Company, the legal basis related to the minutes of the division of the executive group at the company in August 2019, the issue of exporting goods, the issue of contributing capital to increase the company's charter capital, some loans of Hung Viet Company, damages...

The commercial business case regarding “internal company disputes, compensation claims” arose from conflicts in the internal management of Hung Viet Company, especially after the company’s leadership divided the management team according to 3 documents made in August 2019. Up to now, although legally, Hung Viet Company still exists, the consequences of internal conflicts have caused this company to almost “close down”.

Previously, on March 22, the Provincial People's Court also had to issue a decision to postpone the first instance trial of a civil case regarding "internal company dispute; compensation request" related to Hung Viet Agricultural Products Joint Stock Company because the defendants, Mr. Tran Hoang Hiep and Ms. Nguyen Thi Tuyen, were absent from the trial.
