The Ministry of Education and Training has just announced the Draft Circular regulating extra teaching and learning, to solicit comments from now until October 22.
The draft sets out five principles for extra teaching and learning. Extra teaching and learning can only be organized when students have a need for extra teaching, voluntarily take extra teaching and have the consent of their parents or guardians. Organizations and individuals organizing extra teaching and learning cannot use any form of coercion to force students to take extra teaching.
The content of extra teaching and learning must contribute to consolidating and improving knowledge, skills, and personality education of students; must not be contrary to the provisions of Vietnamese law, and must not contain prejudices about ethnicity, religion, occupation, gender, social status, customs and traditions of Vietnam.
The duration, time and location of extra teaching and learning must be suitable for the psychology and age of the students, ensure the health of the students, and comply with legal regulations on security, order, safety and environmental hygiene in the area where extra teaching and learning classes are held.
Do not reduce the content of the subject program in the school's education plan to include additional teaching and learning; do not teach additional content ahead of the distribution of the subject program in the school's education plan; do not use examples, questions, and exercises that have been taught or learned additionally to test and evaluate students.
Do not organize extra teaching and learning in schools for schools that have organized 2 sessions/day.
For subjects that propose extra teaching and learning in schools, the professional group must clearly present the reasons, objectives, content, duration of the proposed extra teaching and learning, and the list of teachers registered to teach extra by subject in each grade.
The principal, based on the proposal of the professional groups, organizes a meeting with the school leaders, heads of the professional groups, and representatives of the school's Parents' Association to agree on the organization of extra teaching and learning in which subjects and in which grades, ensuring practicality, fairness, transparency, and for the benefit of students.
Total teaching time and organization of educational activities according to the school's educational plan and extra teaching and learning must not exceed 35 periods/week for primary school, not more than 42 periods/week for secondary school, and not more than 48 periods/week for high school.
Regarding extra-curricular teaching and learning outside of school, the draft regulation stipulates that organizations or individuals doing business in extra-curricular teaching and learning outside of school must register their business according to the provisions of law; publicize the subjects that are organized for extra-curricular teaching and learning; the duration of extra-curricular teaching of each subject by grade level; the location and time of organizing extra-curricular teaching and learning; the list of extra-curricular teachers and the tuition fees before enrolling students in extra-curricular teaching and learning classes.
Teachers (including Vice Principals or deputy heads) who are working and receiving salaries from the salary fund of general education institutions or public continuing education institutions and participate in extra-curricular teaching outside of school must fulfill the following requirements: Report to the Principal about the subjects, locations, and times of extra-curricular teaching and commit to the Principal to complete assigned tasks and not violate regulations and principles of extra-curricular teaching and learning.
In case a teacher's extracurricular class includes students from the class that the teacher is directly teaching at school, he/she must report and make a list of those students to the Principal and commit not to use any form of coercion to force students to take extra classes.
Principals who participate in extra-curricular teaching must report to and receive approval from the Head of the Department of Education and Training (for junior high schools) and the Director of the Department of Education and Training (for high schools).
The level of tuition fees collected at school is implemented according to the resolution of the Provincial People's Council based on the proposal of the Provincial People's Committee according to regulations. The level of tuition fees collected outside of school is agreed upon between parents, students and the tutoring facility and must be made public before enrolling in tutoring and learning classes. The management and use of tuition fees are implemented according to the provisions of the law on finance, accounting, tax and other relevant regulations.
Currently, regulations on extra teaching and learning are implemented according to Circular No. 17/2012/TT-BGDDT. In which, regulations on cases where extra teaching is not allowed include: Not teaching extra classes for students who have been organized by the school to study 2 sessions/day; not teaching extra classes for primary school students, except for cases of training in arts, physical education, and life skills training. Teachers who are receiving salaries from the salary fund of public service units are not allowed to organize extra teaching and learning outside of school, especially for students who are teaching regular courses.
