More than 20 transportation projects have had their "bottlenecks" regarding construction materials removed.

The Ministry of Transport said that there are 21 projects applying a special pilot mechanism on exploiting minerals for common construction materials.

According to the Ministry of Transport, the 15th National Assembly's approval of the Resolution on piloting a number of specific policies on investment in road construction and a specific pilot mechanism on mining minerals for common materials (resolution) will help many transport projects to remove "bottlenecks" to speed up progress.

One of the notable points of this resolution is that it allows contractors to construct 21 projects (specified in a specific list) during the effective period of this resolution to not have to carry out procedures for granting licenses to exploit minerals for common construction materials included in the construction materials survey dossier.

"Mineral exploitation as prescribed in this clause shall be carried out until the project is completed. In cases where it is not necessary to establish a mineral exploitation investment project, it is not necessary to carry out procedures for preparing an environmental impact assessment report," the resolution clearly states.

A representative of the Department of Construction Investment Management (Ministry of Transport) said that for new material mines, the procedures for granting mining licenses according to the provisions of the Mineral Law are quite complicated, going through many stages and levels.

Specifically: Adjusting and supplementing mineral exploration, exploitation and processing planning; auctioning mineral exploitation rights; preparing mineral exploration projects; issuing mineral exploration licenses; conducting mineral exploration work; approving mineral reserves; preparing investment projects or economic-technical reports on mineral exploitation; issuing mineral exploitation licenses. The implementation time lasts about 10-12 months, making it difficult to meet the progress of project implementation.

"However, with the pilot mechanism allowed by the National Assembly, the time can be shortened by about 8-10 months, contributing to speeding up the implementation of projects," said a representative of the Department of Construction Investment Management.

With the North-South Expressway Project, Phase 2 (2021-2025), which has been previously permitted to apply a special mechanism, according to the guidance of the specialized ministry, the contractor only needs to prepare a registration file for the area, capacity, volume, method, equipment and exploitation plan to submit to the People's Committee of the province where the material mine is located to confirm the registration of the exploitation volume and properly implement the required commitments to complete the material mine granting procedure.

However, according to the Department of Construction Investment Management, in order to exploit materials, contractors must also negotiate compensation prices with the owner.

To ensure consistency, the Prime Minister has issued instructions on "agreeing on transfer prices, leasing land use rights, compensation for trees, crops... for new mines included in the construction material survey dossier serving the project, ensuring compliance with the compensation price level prescribed by the State".

Localities are also required to establish a Working Group including the government, investors, and contractors to negotiate with owners on land transfer and lease prices to ensure they are consistent with the compensation price levels prescribed by the State; and to have sanctions to handle cases of price increases, "price pressure", and land speculation in mining areas.

In reality, some mines are still having difficulty negotiating compensation, with owners demanding high compensation prices. To resolve this issue, in addition to the active participation of localities, State management agencies also need to study and issue guidelines on procedures and principles in negotiating compensation agreements to exploit material mines for projects.

"In the long term, it is necessary to study and amend regulations and mechanisms in the direction of including material mines serving projects in the State's land acquisition area, decentralizing approval for conversion of forest and forest land use purposes, and shortening procedures for investment projects in the construction of traffic works," said a representative of the Department of Construction Investment Management.

The Ministry of Transport said that 21 projects are applying a special pilot mechanism on exploiting minerals for common construction materials, including:

Expressway projects: North-South expressway, eastern section, phase 2; Khanh Hoa - Buon Ma Thuot expressway (phase 1); Bien Hoa - Vung Tau expressway (phase 1); Chau Doc - Can Tho - Soc Trang expressway (phase 1); Tan Phu - Bao Loc expressway; Bao Loc - Lien Khuong expressway; Cao Lanh - An Huu expressway, My An - Cao Lanh expressway; Dau Giay - Tan Phu expressway (phase 1); Dong Dang - Tra Linh expressway (phase 1); Tuyen Quang - Ha Giang expressway (phase 1) - section through Tuyen Quang province; Ninh Binh - Hai Phong expressway, section through Nam Dinh and Thai Binh and Ninh Binh provinces and Ho Chi Minh City - Moc Bai expressway.

Along with that are the projects: Investing in upgrading the Cao Lanh - Lo Te route in Dong Thap province and Can Tho city to reorganize traffic; Investing in building the Cho Moi - Bac Kan route; Ho Chi Minh road section Rach Soi - Ben Nhat, Go Quao - Vinh Thuan; Dai Ngai bridge; investing in expanding the North - South expressway section Cao Bo - Mai Son; upgrading and expanding the Can Tho - Hau Giang route (National Highway 61C) and the project to develop the Mekong Delta transport network to adapt to climate change in Can Tho city - Project 1...
