Deputy holding the position for 10 consecutive years is subject to rotation.
Regulation No. 646-QD/TU replaces Regulation No. 04-QDi/TU dated July 5, 2018 of the Provincial Party Standing Committee.
Regulation No. 646-QD/TU has added many new points compared to Regulation No. 04-QDi/TU, notably expanding the scope of cadre rotation.
According to the new regulations, 4 types of rotated cadres include: Cadres planned for leadership and management positions at all levels; cadres rotated to implement the policy of arranging cadres who are not local people; cadres rotated to implement the policy of heads who have held the position for more than two consecutive terms (8 years) in the same locality, agency, or unit; cadres rotated to implement the policy of deputies who have held the position for 10 consecutive years in the same locality, agency, or unit.
Specifically, the cadres rotated to implement the policy of arranging cadres who are not local people include: Secretaries of District Party Committees, City Party Committees, Town Party Committees; Chairmen of District People's Committees; Chief Prosecutors of People's Procuracies, Chief Justices of District People's Courts; heads of inspection, police, finance, and tax sectors at district level.
Cadres are rotated to implement the policy of heads who have held positions for more than two consecutive terms (8 years) in the same locality, agency, or unit, specifically: Secretaries of District Party Committees, City Party Committees, Town Party Committees, Party Committees directly under the Provincial Party Committee; Chairmen of People's Councils, Chairmen of People's Committees at district level; heads of departments, branches, sectors, Fatherland Front, socio-political organizations at provincial level and equivalent; heads of public service units directly under the People's Committees at provincial and district levels, and public service units directly under departments; heads of departments and equivalent levels of departments, branches, sectors, Fatherland Front, socio-political organizations at provincial level; heads of departments and equivalent levels of departments, branches, Fatherland Front, socio-political organizations at district level; Party Committee Secretaries, Chairmen of People's Committees at commune level.
Cadres are rotated to implement the policy of deputy level who have held the position for 10 consecutive years in the same locality, agency, or unit, specifically: Deputy Secretary of the district-level Party Committee; Vice Chairman of the People's Council, Vice Chairman of the district-level People's Committee; Deputy Head of Department, Branch, Fatherland Front, socio-political organizations at the provincial level and equivalent; Deputy Head of public service units directly under the provincial and district-level People's Committees; Deputy Head of Department; Deputy Head of Public Service Units directly under the Department level (for departments with 2 or more service units); Deputy Head of Department and equivalent of departments, branches, Fatherland Front, socio-political organizations at the provincial level; Deputy Head of Department and equivalent of departments, branches, Fatherland Front, socio-political organizations at the district level; Deputy Secretary of the Party Committee, Vice Chairman of the Commune-level People's Committee; other cases are considered and decided by competent authorities.
The scope of rotation is from provincial level to district level and vice versa; from district level to commune level and vice versa; from one district, town, city to another district, town, city; from one commune, ward, town to another commune, ward, town within the same district, town, city; rotation between agencies, units of the Party, State, Fatherland Front and socio-political organizations, armed forces, public service units, state-owned enterprises in the province.
Transferred staff must have at least 10 years of service.
The transferred cadres must meet the criteria and conditions of having a firm political stance and ideology, good moral qualities; having professional qualifications, expertise, political theory, working capacity and development prospects; meeting the criteria and conditions prescribed for the position held when transferred; and being in good health. The transferred cadres for training and development must have at least 10 years of working time remaining from the time of transfer. In particular, the heads of departments and equivalents of the departments, agencies under the Provincial Party Committee, departments, branches, sectors, the Fatherland Front, and socio-political organizations of the province who are transferred to the district level; the members of the Standing Committee of the District Party Committee, Town Party Committee, City Party Committee and equivalents, Vice Chairmen of the People's Council, People's Committee of districts, towns and cities who are transferred to provincial-level agencies; and the heads and deputy heads of departments, branches, sectors, the Fatherland Front, and socio-political organizations at the district level and equivalents who are transferred to the commune level, must have at least 13 years of working time remaining. Special cases are considered and decided by competent authorities.
Regarding the principle of assigning positions during rotation, Regulation No. 646-QD/TU states: “Basically, the principle of assigning positions equivalent to the current position shall be implemented. If necessary, the competent authority shall consider and decide to assign a position higher than the current position to cadres with outstanding qualities and abilities, and the ability to meet the requirements of the expected assigned and arranged position.”
Staff rotation period is at least 3 years
The new regulation defines the minimum rotation period for cadres as 3 years (36 months), with special cases decided by competent authorities.
The principle of arranging cadres after rotation is determined as follows: The arrangement of work for cadres after rotation must be based on the Party's cadre work requirements, political tasks, the situation of cadres of localities, agencies, units and the results of work, capacity, and strengths of cadres associated with the implementation of political tasks of localities, agencies, units and comments and assessments of cadres by competent authorities. In case the rotated cadre is decided by competent authorities to continue to be arranged to work stably in the locality or unit where he/she arrives, he/she is no longer considered a rotated cadre according to regulations.
Compared to the old regulations, the connotation of the phrases “cadre rotation”, “local people”, “cadres holding positions for more than 2 consecutive terms” in the new regulations has also been adjusted. Specifically, according to the new regulations, cadre rotation is the assignment or appointment of cadres, civil servants, leaders, and managers to hold another leadership or management position for a certain period of time to continue training, fostering and practicing according to the requirements of the task or the requirements of the planned position.
A local person is a person whose hometown is in that locality (except in the case where the hometown is in that locality but 3 generations were born, raised and live in another locality) or a person whose hometown is in another locality but 3 generations were born, raised and live in that locality.
A cadre holding a position for more than two consecutive terms is a person holding a head position continuously for 8 years or more, a cadre holding a deputy position continuously for 10 years in the same locality, agency or unit.
The new regulation adds the principle of "No additional positions are added to rotate cadres (except in cases where the Politburo has separate regulations)".
Regulation No. 646-QD/TU also inherits many important and reasonable points of Regulation No. 04-QDi/TU, while editing, supplementing, specifying and abolishing points that are no longer suitable.
