Is it illegal for a driver to stop and put on a raincoat while riding a motorbike in the rain? Which law regulates this?
Regulations on stopping and parking
Clause 3 and Clause 4, Article 18 of the 2008 Road Traffic Law stipulate the obligations of vehicle drivers when stopping or parking on the road as follows:
- There is a signal to let other vehicle drivers know.
- Stop or park your vehicle at a place with a wide sidewalk or on land outside the roadway. In case the sidewalk is narrow or there is no sidewalk, you must stop or park your vehicle close to the right edge of the road in the direction of travel.
- In case there are built parking lots or designated parking lots on the road, vehicles must stop or park at those locations.
- After parking, you may only leave the vehicle after taking safety measures; if the vehicle is parked and occupies part of the roadway, you must immediately place a danger sign in front and behind the vehicle to alert other drivers.
- Do not open the car door, leave the car door open or get out of the car when safety conditions have not been ensured.
- When stopping the vehicle, do not turn off the engine and do not leave the driving position.
- Vehicles parked on slopes must have their wheels chocked.
Please do not stop or park your vehicle in the following locations:
- Left side one way street.
- On curves and near the top of slopes visibility is obstructed.
- On the bridge, under the overpass.
- Parallel to another stopped or parked vehicle.
- On the crosswalk.
- At intersections and within 5m from the edge of the intersection.
- Bus stop.
- In front of the gate and within 5m on both sides of the gate of the headquarters of agencies and organizations.
- Where the road is only wide enough for one lane.
- Within the safety range of the railway.
- Obscuring road signs.
Is it illegal to stop a car wearing a raincoat?
When drivers stop their vehicles to wear raincoats, they must comply with the conditions for stopping and parking. Otherwise, they may be subject to administrative penalties depending on the behavior and type of vehicle, the nature and level of danger of the driver's behavior.
In the case of motorbikes and mopeds (including electric motorbikes) that stop wearing raincoats in violation of regulations (Article 6 of Decree 100/2019/ND-CP amended by Clause 34, Article 2 of Decree 123/2021/ND-CP), the fine will be as follows:
Fine from 300-400 thousand VND for the following acts:
- Stopping or parking on the roadway on suburban roads where there is a sidewalk.
- Stopping or parking on urban roads causes traffic obstruction.
- Stopping or parking on tram tracks or bus stops.
- Stopping or parking on tram tracks, bus stops, at road intersections, on pedestrian crossings; stopping where there is a "No stopping and parking" sign; parking where there is a "No parking" sign or a "No stopping and parking" sign...
Fine from 400-600 thousand VND for the following acts:Stop, park on the bridge.
Fine from 800 - 1 million VND for the following acts:Stopping or parking in a road tunnel in an incorrect location.
Fine from 4 - 5 million VND for the following acts:Stopping and parking in violation of regulations causes traffic accidents.
For cyclists, motorbike riders (including electric bicycles) (in Article 8 of Decree 100/2019/ND-CP) who stop their vehicles wearing raincoats in violation of regulations, the fine will be as follows:
Fine from 80 - 100 thousand VND for the following acts:
- Stopping suddenly or changing direction without signaling.
- Stopping or parking on the roadway on suburban roads where there is a sidewalk.
- Stopping or parking in a road tunnel in an incorrect location.
