Previously, Article 7 of Decree 138/2013 stipulated administrative sanctions for violations of extra-curricular tutoring. However, Decree 04/2021, which replaces Decree 138/2013, no longer stipulates administrative sanctions for this violation.

Accordingly, teachers who are civil servants and arbitrarily organize extra cultural classes for primary school students may be considered to have violated the things that cadres, civil servants, and public employees are not allowed to do according to Article 19 of the 2010 Law on Civil Servants.

Cadres, civil servants, and public employees who violate the things that cadres, civil servants, and public employees are not allowed to do will be subject to disciplinary measures such as reprimand, warning, dismissal, or removal from office, depending on the severity.

3 cases where extra teaching and organizing extra classes are not allowed

Article 4, Circular 29/2024 stipulates 3 cases where extra teaching and extra teaching are not allowed as follows:

  • Do not organize extra classes for primary school students, except in the following cases: art training, physical education, and life skills training.
  • Teachers are not allowed to teach extra classes outside of school for money from their own students who are teaching at school.
  • Teachers in public schools are not allowed to participate in the management and operation of extra-curricular teaching but can participate in extra-curricular teaching.

In addition, Circular 29/2024 also stipulates that organizations or individuals organizing extra-curricular teaching and learning activities outside of school that collect fees from students must publicly announce on the electronic information portal or post at the place where the extra-curricular teaching facility is located the subjects that are organized for extra teaching.

At the same time, publicize the duration of extra teaching for each subject according to each grade level; location, form, time of organizing extra teaching and learning; list of extra teachers and tuition fees before enrolling students in extra teaching and learning classes.
