Former Chairman of Binh Thuan Province People's Committee Le Tien Phuong and many subordinates were brought to trial on charges of wrongdoing in approving land prices at the Phan Thiet coastal urban tourism project, causing losses of more than VND308 billion.
According to the decision of the Hanoi People's Court, on January 17, 2025, the case of "violating regulations on management and use of State assets causing waste and loss" occurring at the Phan Thiet Urban Area Project (Binh Thuan) will be brought to trial under the first instance procedure.
17 defendants were brought to trial for violations in the management and use of state assets, causing loss and waste. Among those brought to trial were Mr. Le Tien Phuong (former Chairman of the People's Committee of Binh Thuan Province); Xa Duong Thang (former Director of the Department of Construction, former Secretary of the Bac Binh District Party Committee); Ho Lam (former Director of the Department of Natural Resources and Environment); Do Ngoc Diep (former Chairman of the People's Committee of Phan Thiet City); Nguyen Van Phong (former Vice Chairman of the Provincial People's Committee).
Judge Vu Quang Huy presided over the trial. Representatives of the Hanoi People's Procuracy attending the trial included Ms. Tran Thi Thanh Huyen, Dao Thuy Chinh, Ngo Thi Huyen Phuong, Do Hong Hai and Mr. Nguyen Duc Anh.
Binh Thuan Provincial People's Committee, Rang Dong Joint Stock Company; Southern Information and Valuation Joint Stock Company were summoned to court as parties with related rights and obligations.
This is a particularly serious case, occurring in the field of state management of land in Binh Thuan province. As Chairman of the Provincial People's Committee and Chairman of the Land Valuation Council, Mr. Le Tien Phuong directed the implementation of the Phan Thiet Urban Tourism Area project.
According to the accusation, Mr. Le Tien Phuong clearly knew the detailed planning project and land use structure of Phan Thiet coastal urban tourism area; the Valuation Council fully reported on the implementation process, appraisal results of SIVC Company's land price consultancy and the Draft land price plan of the Department of Natural Resources and Environment.
But the defendant still agreed with the results of land price consultation and land price plan developed by the Department of Natural Resources and Environment, in which the comparable assets that did not meet the conditions and were not based on the approved detailed planning were used as the basis for calculating and calculating the price of high-rise buildings using the same method and method of determination as for villas and townhouses.
The former Chairman of the People's Committee of Binh Thuan province also signed and issued a decision approving land prices at the Phan Thiet coastal urban tourism project at a price of more than 2.5 million VND/m2, contrary to legal regulations and the direction of the Provincial Party Committee Standing Committee.
Committing the crime with defendant Le Tien Phuong were other defendants who were former leaders in Binh Thuan. They, in different roles, intentionally violated their assigned duties in the process of developing and appraising land price plans; and agreed to use the results of land price determination.
In which, using unqualified comparable assets without approved detailed planning as the basis for calculation; calculating the general price of high-rise land such as villa land, townhouses and estimating the total revenue from developing high-rise land from transferring high-rise land area is against the law and against the direction of the Provincial Party Committee Standing Committee.
Regarding the case, the defendants Nguyen Van Tho, Truong Van Ri and Ho Nhu Hai of the Valuation Consulting Company agreed together to build the Valuation Certificate, in which they used comparable assets that did not meet the conditions, without the basis of the approved detailed planning as the basis for calculating and generalizing the price of high-rise land such as villa land, townhouses and estimating the total revenue from developing high-rise land from the transfer of high-rise land area, not in accordance with the regulations and principles of the surplus method, and were accomplices with the defendants at state management agencies.
