What is the penalty for issuing a health certificate without a full medical examination?

Pursuant to Article 46, Decree No. 117/2020/ND-CP stipulates penalties for violations of regulations on health examination as follows:

Article 46. Violation of regulations on health examination

1. A fine of from VND 3,000,000 to VND 5,000,000 shall be imposed for one of the following acts:

a) Providing a health certificate when not performing a full medical examination as required;

b) Health classification is not correct with the health status of the person requesting the health examination.

2. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for failure to ensure one of the conditions of a health examination facility.

3. A fine of VND 10,000,000 to VND 20,000,000 shall be imposed for conducting a health examination without announcing the implementation of the health examination.

4. Additional penalties:

a) Suspend the health examination activities of the facility for a period of 1-3 months for the acts specified in Clause 2 of this Article;

b) Revoke the right to use the license to operate medical examination and treatment for a period of 1 - 3 months for the acts specified in Clause 3 of this Article.

Thus, according to regulations, the act of providing a health certificate to an employee without fully examining the required contents is a violation of regulations on health examination.

This behavior may be administratively punished by a fine of 3,000,000 VND to 5,000,000 VND.

Note: The fines prescribed above are for individuals. For the same administrative violation, the fine for an organization is twice the fine for an individual (Clause 5, Article 4, Decree No. 117/2020/ND-CP).
