Ministry of Education and Training loosens management in organizing foreign language certification exams

The above content is mentioned in the conclusion of the inspection of the responsibility for performing public duties of cadres, civil servants and public employees in handling administrative procedures and providing public services to people and businesses at the Ministry of Education and Training, issued by the Government Inspectorate.

According to the inspection conclusion, the Ministry of Education and Training has loosened management, allowing violations in the organization of foreign language proficiency exams to continue for a long time, but has not taken timely measures to prevent, correct, and handle them, causing public outrage.

Specifically, many units have organized certification exams without permission from the Ministry of Education and Training according to the provisions of Decree No. 86/2018 of the Government on regulations on foreign cooperation and investment in the field of education.

The Government Inspectorate determined that the process took place when handling the administrative procedure "Approving the association to organize foreign language proficiency exams" before Circular No. 11/2022 of the Ministry of Education and Training on guidelines for implementing democracy in the activities of public educational institutions took effect (August 2018 to September 2022).

According to the Government Inspectorate, the regulations on joint activities to organize foreign language proficiency exams in Decree No. 86/2018 still have some unclear contents, such as: Not explaining the terms "joint activities in education and training with foreign countries" and "joint activities to organize foreign language proficiency exams".

In addition, the regulations and instructions in Decree No. 86/2018 are not specific on the conditions for "demonstrating the quality assurance of organizing exams" to issue foreign language proficiency certificates, while the Investment Law 2020 stipulates that joint training activities with foreign countries are a conditional business line...

Based on the inspection results, the Government Inspector General recommended that the Prime Minister direct the Ministry of Education and Training, within its authority, to review, propose amendments, supplements, and overcome a number of loopholes and inadequacies in legal regulations.

In particular, review and propose to amend the administrative procedure "Approval of joint organization of foreign language proficiency certificate exams" in Decree No. 86/2018 in the direction of specifying conditions to prove the quality assurance of foreign language proficiency certificate exams; supplement regulations explaining terms on joint organization of foreign language proficiency certificate exams in accordance with the Investment Law.

The Government Inspector General requests the Minister of Education and Training, on the basis of amending and supplementing Decree No. 86/2018 as above, to review, amend, supplement or issue a circular to replace Circular No. 11/2022 in accordance with the authority assigned to the Minister; not to create requirements and conditions that may cause trouble for people and businesses when carrying out the administrative procedure "Approving joint organization of foreign language proficiency certificate examinations".

The Government Inspector General requested the Minister of Education and Training to review, implement according to authority or recommend competent authorities measures to rectify, handle violations, and remedy consequences (if any) for organizations, units, and individuals involved in the field of joint organization of foreign language proficiency certification exams, ensuring compliance with legal regulations, ensuring the rights and legitimate interests of participants in the certification exam.

Regarding this content, the Government Inspector General pays special attention to the period from August 2018 to September 2022 - from the time Decree No. 86/2018 takes effect to before the time Circular No. 11/2022 takes effect.

The Minister of Education and Training is also required to rectify the approval of joint activities to organize certificate exams, ensuring strict compliance with relevant legal regulations, publicity, transparency, and no negativity or resentment in society.
