Minister of Industry and Trade Nguyen Hong Dien has just signed Decision No. 2355/QD-BCT promulgating the Regulation on managing the digital data connection activities of the Electronic Certificate of Origin Management and Issuance System (eCoSys System) with units operating in the field of information technology providing value-added services on electronic transactions in the field of electronic certificate of origin issuance of the Ministry of Industry and Trade (VAN Organization).
According to the Regulations of the Ministry of Industry and Trade, the activities of managing and connecting digital data of the VAN Organization include: managing and administering digital data, connecting technical infrastructure; rights and responsibilities in connecting data and other related activities.
The Regulations also clearly state that the following acts are prohibited: buying, selling, and exchanging data in violation of the law; falsifying data during data transfer; destroying information infrastructure, interrupting data connections; violating regulations on intellectual property rights and personal information protection rights when connecting data.
Regarding the principles of providing, managing and using information, the Ministry of Industry and Trade stipulates that the information and data provided must be complete according to the structure and format provided by the Ministry of Industry and Trade.
Above all, the information and data provided to the Ministry of Industry and Trade's server must be in chronological order. The workstation of the VAN Organization sending data and the Ministry of Industry and Trade's server must be synchronized with the national standard time according to the NTP (Network Time Protocol) standard.
In addition, the information and data provided must be timely, accurate, complete, and must not be modified or falsified before, during or after data transmission. At the same time, the information and data provided must be used in accordance with the Government's regulations on the application of information technology in the operations of state agencies and used in state management.
On the other hand, the Regulation requires public disclosure of information about the focal point in charge of connection; information about data connection readiness; compliance with regulations on information security, regulations on intellectual property rights related to data, and privacy of organizations.
The regulations on information are clearly stated by the Ministry of Industry and Trade in the Regulation that: The information provided is divided into two types, including default identification information and continuously updated information; default identification information includes the list of organizations issuing C/O, the list of countries, the list of units of measurement and other information fields as required by the professional standards for issuing electronic certificates of origin provided by the Ministry of Industry and Trade.
Accordingly, the information of each set of C/O includes the C/O number, information about the goods for which C/O is requested, and other information fields as required by the professional standards for issuing electronic certificates of origin provided by the Ministry of Industry and Trade.
In addition, the Regulation also requests information from the unit requesting the issuance of C/O, including tax code, unit name, phone number and other information fields as required by the professional standards for issuing electronic certificates of origin provided by the Ministry of Industry and Trade.
The Ministry of Industry and Trade said that the VAN Organization's application has the function of declaring to the centralized receiving system, the connection message standard is continuously updated according to the eCoSys System. The value of the C/O dossier declared on the VAN Organization's application is recognized and has the same legal value as the C/O dossier declared directly through the eCoSys System.
The Ministry of Industry and Trade also clearly stipulates the conditions for participating in the pilot data connection with the eCoSys System for VAN Organizations, which are legal entities registered to operate for at least 3 years or more (priority is given to enterprises that have projects or programs to support traders in the field of import and export).
At the same time, the Ministry also clarified that this unit is operating normally, not violating the law, not owing taxes; has facilities, network infrastructure and software systems that meet the requirements for seamless data connection, ensuring information security and network security. In particular, the unit must have a connection plan that has been assessed and approved by the Import-Export Department and the Department of E-Commerce and Digital Economy.
