With strong leadership and specific solutions, the clearance of traffic safety corridors in some localities in Hai Duong has had positive changes. The difficult problem of handling these violations has been solved.
Determined to "erase" violations
On July 25, 2023, at km 4+708 of Provincial Road 398, Mr. NDB's family in Cong Hoa Ward (Chi Linh) organized the construction of foundations and gate walls in the road traffic corridor, 12.5 m from the center of Road 398, 20 m along the road surface. Immediately after discovering the violation, the People's Committee of Cong Hoa Ward and the City Urban Order Management Team came to propagate and remind the householder to build according to the traffic safety corridor boundary. Thereby, Mr. B's family demolished all walls, foundations and built a wall back to ensure the correct traffic safety corridor boundary.
Previously, at km78+400 of National Highway 37, Mr. DVN in Dong Lac Ward (also in Chi Linh) leveled the ground on land converted from crop structure in the traffic corridor, 15m along the road. Mr. N. was issued a decision by the People's Committee of Dong Lac Ward to impose an administrative penalty. Mr. N. has complied with the fine, made repairs, and restored the original state.
The above are 2 examples of 11 cases of violations of road traffic safety corridors in Chi Linh that have been resolved. Chi Linh City is also the only locality in the province where there are currently no violations of road traffic safety corridors on national highways and provincial roads.
To strengthen the management of order, sidewalks, roadsides, and illegal construction on traffic corridors, every year, the Traffic Safety Committee of Chi Linh City coordinates to clear violations of traffic safety corridors. The City People's Committee regularly directs the Urban Management Department, the Urban Order Management Team, and road management units to coordinate with the People's Committees of communes and wards to inspect and handle encroachment on roadsides and sidewalks for selling goods, gathering materials, washing cars, and holding markets, especially clearing encroachment on roadsides of Van An, Tan Dan, An Lac, Thai Hoc, and Sao Do markets. Regarding the handling of illegal construction and encroachment on road and railway traffic safety corridors, the City People's Committee requires communes and wards to strengthen inspection and handling of violations to promptly prevent them. If there are violations, they will be punished, resolutely handled, and the violating construction will be dismantled. In case the violators do not dismantle them themselves, coercive measures will be applied.
At the meeting to review the work of ensuring traffic safety and order in the first 7 months of 2023 and deploy tasks for the last months of 2023, Comrade Luu Van Ban, Member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Provincial People's Committee, Deputy Head of the Provincial Traffic Safety Committee, directed to complete the clearance of all violations of road land and road safety corridors before September 30, 2023. Implementing this direction, the People's Committee of Ninh Giang district has developed a plan and focused on handling and clearing violations of traffic safety corridors on national highways and provincial roads in the district. As a result, Ninh Giang has cleared 28 violations. The remaining cases are mostly violations on land that has been granted land use right certificates; violations by households do not affect traffic safety visibility...
Solve each group of problems
According to the statistics compiled by October 2023, the People's Committees of districts, cities and towns have handled 158 cases out of a total of 625 cases of traffic corridor violations; there are still 467 cases that have not been resolved. Of which, localities are developing plans to resolve 28 cases in the coming time.
For the more than 400 remaining cases, they are divided into 5 typical groups. The first group is violations of construction works, leveling, and connections by organizations and enterprises that are in accordance with planning but lack procedures according to regulations. The second group is violations of construction works, leveling, and connections by individuals, organizations, and enterprises that are illegal and not in accordance with planning. The third group is violations of households living on both sides of the road who build works within the road safety corridor (mainly permanent houses) on legal residential land that has been granted a land use right certificate or land with documents. The fourth group is violations of households living on both sides of the road who build works (mainly temporary houses, sheds, roofs, gates, fences, etc. in front of legal land) on illegal public land within the road safety corridor. The fifth group is the violations that regularly encroach on the roadway, sidewalks, and pavements to hold markets, display stalls, advertise, gather construction materials, and set up tents for funerals, weddings, etc. on the roads.
According to localities, the problems, difficulties and obstacles in handling traffic corridor violations are mainly in groups three and four. Many violations are in legal land areas that have not been compensated for site clearance according to regulations; organizations and individuals still deliberately build and encroach on public land (outside the legal land area) in the road safety corridor for production and business purposes...
The Department of Transport has proposed different solutions for each group of violations, all in the spirit of "clear work, clear responsibility", specifying the implementation content and mobilizing the entire political system to participate. For complicated cases, the handling must ensure the process and stabilize the local political, economic and social situation, and at the same time, request the People's Committee at the district level to develop a handling plan and report to the Provincial People's Committee for consideration and direction.
