On September 26, Hai Duong Provincial People's Court held a first-instance trial of 6 defendants for bribery.
According to the indictment of the People's Procuracy of Hai Duong province, from November 2021 to October 2022, Nguyen Phu Nam (born in 1979, residing in Cong Hoa commune, Nam Sach), Do Van Kien (born in 1991, residing in Tu Minh ward, Hai Duong city), Bui Trong Quyen Anh (born in 1990, residing in Gia Tan commune, Gia Loc) and Ha Van Toan (born in 1990, residing in Te Lo commune, Yen Lac district, Vinh Phuc) were all Deputy Directors of the two Inspection Centers 34-04D and 34-05D.
These 4 subjects are also inspectors, taking advantage of their assigned positions and powers to discuss and agree with Nguyen Van Phuc (born in 1991, residing in Tien Dung commune, Yen Dung district, Bac Giang), Director of Alpha Company and Pham Van Nang (born in 1983, residing in Thanh Binh ward, Hai Duong city), Director of Thien An Company to receive bribes totaling more than 236 million VND from 12 vehicle owners. The 2 above-mentioned enterprises are responsible for designing and constructing the renovation of road motor vehicles.
The subjects instructed 12 vehicle owners to take their vehicles to outside construction sites for renovation. The defendants then assigned tasks to legalize construction documents, inspect and accept vehicles, and issue certificates of technical safety and environmental protection for the renovated motor vehicles.
In this case, Phuc received bribes 20 times with a total amount of more than 208 million VND, Quyen Anh and Toan received bribes 12 times with a total amount of more than 114 million VND, Kien and Nam received bribes 11 times with a total amount of more than 122 million VND, and Nang received bribes 3 times with a total amount of more than 28.5 million VND.
At the end of the trial, the jury sentenced Nguyen Van Phuc to 5 years in prison, Bui Trong Quyen Anh to 4 years in prison, Ha Van Toan to 4 years in prison, Do Van Kien to 4 years in prison, Nguyen Phu Nam to 3 years and 6 months in prison, and Pham Van Nang to 30 months in prison, all for bribery.
12 vehicle owners have filed complaints against the defendants' actions or actively cooperated, proactively declared and provided documents and evidence for the Investigation Agency to initiate criminal proceedings and prosecute the defendants. Pursuant to Clause 7, Article 364 and Point c, Clause 2, Article 29 of the Penal Code, the prosecution agency will not consider prosecuting these 12 vehicle owners.
