Employees are paid severance pay when they leave their jobs.

Pursuant to Article 46 of the 2019 Labor Code, employees who have worked regularly for an employer for 12 months or more will be paid severance pay when they quit their job. This benefit is excluded for those who are eligible for pension.

Therefore, to be paid severance pay, employees need to quit their jobs before they are eligible for pension. Correspondingly, people who quit their jobs to receive unemployment benefits before they are eligible for retirement will be paid severance pay.

Severance pay is calculated based on the period of employment for which unemployment insurance has not been paid, with half a month's salary being paid for each year of employment. Typically, employees will be paid severance pay corresponding to their probationary period and maternity leave.
