Violating alcohol concentration will result in revoking a motorbike driving license, but can you still drive a car?

Question: If a person violates alcohol concentration and has his/her motorbike driving license revoked, can he/she continue to drive a car? And which law regulates this case?

Reply:Currently, there are two types of driving licenses: integrated driving licenses and individual driving licenses. In which, integrated driving licenses are the type of license that combines 2 or more unlimited driving licenses with a limited driving license.

It is important to understand that Circular 12/2017 of the Ministry of Transport does not require people to integrate their motorbike driving license with their car driving license. Whether to integrate or separate is entirely up to the people to decide.

According to Clause 4, Article 4 of Circular 37/2017 of the Ministry of Transport (Circular stipulating the form of minutes and decisions used in handling administrative violations in the field of road and railway traffic), it is stipulated that:

In case an administrative violator has an integrated driving license and is subject to the penalty of revocation of the right to use the driving license according to the provisions of the Government's Decree on administrative penalties for violations in the field of road and railway traffic, the person with the authority to decide on the penalty must clearly state in the decision on the administrative penalty the types of vehicles allowed to be driven under the driving license and apply the penalty of revocation of the right to use the driving license for a limited period or an unlimited driving license for the type of vehicle used when committing the violation.

Administrative violators are allowed to drive the remaining types of vehicles listed on their driving license.

Thus, in the decision to impose administrative penalties, the competent authority will clearly state that the right to use a motorcycle driving license is revoked in the integrated driving license. Therefore, the driver can still drive a car if there is no decision to revoke the license for this type.

Note, when driving a car, the driver must carry the above administrative penalty decision or other documents containing this information for convenience in traffic and when documents are checked.
