The court requested further investigation into the fraudulent behavior of the "rightly admitted, wrongly argued" betel nut-picking medium in Kinh Mon.

According to the court, along with the act of taking advantage of superstition and using deceitful tricks to appropriate the property of Mr. T. and his wife in Kinh Mon and Mr. X. and his wife in Hai Phong, Huong also received money to tell fortunes and perform ceremonies for many people, as shown in the "Debt reporting savings account" that the bank had copied from defendant Huong's account and provided to the investigation agency.

From July 1-31, 2022, Huong's account had more than 895 million VND transferred, including 7 money transfer transactions related to Huong receiving money for the ceremony, the total amount received was 399.5 million VND.

From December 1-31, 2022, Huong's account generated more than 784 million VND. Of which, there were 5 money transfer transactions related to Huong receiving money for the ceremony with a total amount of 144 million VND.

From January 1 to February 23, 2023, defendant Huong's account generated more than VND 976 million. Of which, there were 4 money transfer transactions related to defendant Huong receiving money for the ceremony, the total amount received was VND 115.7 million.

On April 3, 2024, the People's Procuracy of Kinh Mon Town sent an official dispatch requesting the Investigation Police Agency (Kinh Mon Town Police) to clarify and handle according to the provisions of law the defendant's behavior related to the money transfer transactions for the ceremony. The Investigation Police Agency of Kinh Mon Town Police determined that it had verified but there was no basis to handle according to the provisions of law.

At the trial, Huong stated: “The defendant confirmed that he no longer remembers the fortune-telling and receiving money through the account. The defendant confirmed that he was wronged and requested the Trial Panel to exonerate him.”

The trial panel determined that the documents and evidence in the case file did not show that the Investigation Police Agency of Kinh Mon Town Police verified and investigated the cases of money transfers to Huong's account for ceremonies and fortune telling.

Therefore, there is reason to believe that in addition to the act of using fraudulent means to appropriate the property of the two victims that the People's Procuracy of Kinh Mon town has prosecuted, defendant Huong also received money for fortune telling through her account but has not been investigated and handled according to regulations.

From the above analysis, the Trial Panel decided to return the case file to the People's Procuracy of Kinh Mon town for further investigation: Conduct a search for information on the account holders who transferred money to the defendant Huong's account, including some cases with transfer content related to the ceremony and deposit for the ceremony. Record the statements of those who transferred money for the ceremony about whether or not there was fraudulent behavior to appropriate the defendant Huong's property for handling according to regulations.
