On the morning of March 14, the Union of Science and Technology Associations of Hai Duong province coordinated with the Provincial Bar Association to organize a talk on Cyber Security Law in the digital transformation period with 300 students of Hai Duong Central College of Pharmacy.
During the talk, among the questions was a question from student Doan Thi Thuy My, Hai Duong Central College of Pharmacy: “Recently, on social networks, there has been false and unofficial information about the arrangement, streamlining of the apparatus, and merger of localities. Lawyer, please tell me if you interact, post, share or comment, how will you be handled?”
Lawyer Tran Trung Kien, A Dong Law Office (Hai Duong Provincial Bar Association) said that recently, the reorganization of the political system according to Resolution No. 18-NQ/TW of the 12th Party Central Committee has received special attention from the whole society. In Hai Duong, the implementation of streamlining the apparatus has been implemented vigorously, with unity in perception and action in accordance with the major policies of the Party and State.
According to the provisions of Article 101, Decree 15/2020/ND-CP dated February 3, 2020 of the Government, amended by Decree 14/2022/ND-CP, the act of providing or sharing fake information, false information, distorting, slandering, insulting the reputation of agencies, organizations, honor, dignity of individuals, or providing or sharing fabricated information, causing confusion among people, inciting violence, crimes, social evils, gambling or serving gambling shall be subject to an administrative fine of 10 - 20 million VND. In addition, violators shall also be subject to remedial measures such as being forced to remove false or misleading information.
According to Article 117 of the 2015 Penal Code, anyone who commits one of the following acts against the State shall be sentenced to imprisonment from 5 to 12 years. Specifically: Making, storing, disseminating or propagating information, documents or items with content that distorts or defames the people's government; making, storing, disseminating or propagating information, documents or items with fabricated content, causing confusion among the people. If the crime is committed in particularly serious cases, the penalty is imprisonment from 10 to 20 years.
According to consulting lawyers, people accessing information on social networks need to be alert to speculative and fabricated information, especially information on pages of subjects who regularly engage in activities against the Party and the State, distorting the policy of rearranging and streamlining the apparatus of the political system to sabotage and cause political instability.
Students and citizens need to access accurate information during the implementation of the policy of rearranging administrative units on the official information portals of the Party and the State. Absolutely do not share or comment on information that is speculative, baseless, or distorted to avoid violating legal regulations that may be subject to prosecution.
