On the evening of March 21, Phu Yen Provincial Police prosecuted and temporarily detained subjects who created fake documents of Phu Yen Provincial People's Committee and Phu Yen Provincial Department of Natural Resources and Environment to defraud and appropriate property.
The subjects prosecuted include: Huynh Chi Linh (born in 1997, permanent resident of Dong Hai district, Bac Lieu province) and Nguyen Mau Van (born in 1985, permanent resident of Tuy Hoa city, Phu Yen province) for the act of fraud to appropriate property as prescribed in Clause 4, Article 174 of the Penal Code.
According to the investigation results: in 2023, Huynh Chi Linh and Nguyen Mau Van agreed to provide false information and documents. Mr. Nguyen Van Binh believes that Linh and Van were able to complete the relevant documents to change the form of land lease from annual payment to one-time payment for the entire land lease period for land plot No. 103, map sheet No. 38, area 25,000 m2 (in Xuan Hai commune, Song Cau town, Phu Yen province) of Duy Tin Tourism and Service Company Limited.
Huynh Chi Linh and Nguyen Mau Van created fake PDF files of documents (no paper documents) including: Conclusion No. 1242/KL-STNMT, dated July 14, 2023 of the Department of Natural Resources and Environment of Phu Yen province, resolving the dossier to change the form of land lease with annual payment to land lease with one-time payment for the entire lease term of the project in the province; Decision No. 1846/QD-UBND, dated August 4, 2023 of the People's Committee of Phu Yen province on changing the form of land lease from annual payment to one-time payment for the entire land lease term for Duy Tin Tourism and Services Company Limited and Decision No. 1476/QD-STNMT, dated December 25, 2023 of the Department of Natural Resources and Environment of Phu Yen province on allowing Duy Tin Tourism and Services Company Limited to change the form of land lease from annual payment to one-time payment for the entire land lease term in Xuan Hai commune, Song Cau town, Phu Yen province.
After that, these subjects sent fake text files via Zalo to Mr. Nguyen Van Binh so that he would trust them and give him money. Huynh Chi Linh and Nguyen Mau Van appropriated more than 1 billion VND from Mr. Nguyen Van Binh.
The above actions of Linh and Van constitute the crime of Fraudulent appropriation of property as prescribed in Clause 4, Article 174 of the Penal Code.
