In April 2024, several notable new policies will come into effect.
New regulations on salaries, remunerations, and bonuses in single-member LLCs with 100% state capital
On February 23, 2024, the Government issued Decree 21/2024/ND-CP amending and supplementing a number of articles of Decree No. 51/2016/ND-CP dated June 13, 2016 regulating labor management, wages and bonuses for employees working in single-member limited liability companies with 100% charter capital held by the State and Decree No. 52/2016/ND-CP dated June 13, 2016 regulating wages, remuneration and bonuses for managers of single-member limited liability companies with 100% charter capital held by the State.
Decree amending regulations on salary scales, payrolls, and salary allowances for employees. Accordingly, the Decree amends Article 4 of Decree No. 51/2016/ND-CP on salary scales, payrolls, and salary allowances for employees working in single-member limited liability companies with 100% state capital.
Specifically, based on production organization and labor organization, the company builds and issues salary scales, payrolls, and salary allowances as the basis for salary arrangement, salary payment, and implementation of regimes for employees according to the provisions of labor law.
The salary levels in the salary scale, salary table, and salary allowances are decided by the company, but must ensure that the salary fund calculated according to the salary levels in the salary scale, salary table, and salary allowances does not exceed the planned salary fund of employees according to regulations.
When developing or amending and supplementing salary scales, salary tables and salary allowances, the company must consult with the organization representing employees at the facility, organize dialogues at the workplace according to regulations, report to the owner's representative agency for comments and make it public at the company before implementation.
The Decree also amends and supplements Points a and b, Clause 3, Article 5 of Decree No. 51/2016/ND-CP on determining the planned salary fund. In addition, Decree No. 21/2024/ND-CP also amends and supplements Decree No. 52/2016/ND-CP regulating salaries, remunerations, and bonuses for managers of single-member limited liability companies in which the State holds 100% of the charter capital.
Decree No. 21/2024/ND-CP takes effect from April 10, 2024.
Detailed regulations on the order and procedures for considering and posthumously awarding the "Glorious Youth Volunteer Medal"
Recently, the Government issued Decree No. 28/2024/ND-CP detailing the procedures for considering and awarding the "Glorious Youth Volunteer Medal" and the commendation of achievements in the resistance war. The Decree will take effect from April 20.
Decree 28 details the procedures for considering and awarding the "Glorious Youth Volunteer Medal" to Youth Volunteers who have completed their tasks in the resistance wars to protect the Fatherland, ensuring feasibility and facilitating the research and implementation process in practice. Youth Volunteers are awarded Medals and Medal Certificates and continue to enjoy benefits according to the regulations on resistance war rewards.
Mr. Pham Huy Giang, Head of the Central Emulation and Commendation Committee (Ministry of Home Affairs) said that in order for the law on emulation and commendation to be implemented as soon as the Law on Emulation and Commendation takes effect (January 1, 2024), the development and promulgation of a decree detailing the procedures for considering and posthumously awarding the "Glorious Youth Volunteer Medal" and the commendation of achievements in the resistance war is necessary and in accordance with the provisions of law.
During the resistance war against France and the US to save the country, the Youth Volunteer Force served directly on battlefields, in difficult and arduous areas, and in fierce war zones to carry out tasks such as opening roads, ensuring traffic, serving in combat, participating in combat, clearing bombs and mines; carrying wounded and dead soldiers, transporting weapons, ammunition, food, clearing battlefields, participating in international missions to help Laos and Cambodia, and participating in protecting the northern and southwestern borders.
According to the report of the Vietnam Association of Former Youth Volunteers, up to now, the number of Youth Volunteers participating in the resistance wars and defending the Fatherland has been confirmed to be about 420,000 people (including martyrs, wounded soldiers, sick soldiers, and people infected with toxic chemicals).
Conditions and criteria for awarding the Ho Chi Minh Prize and the State Prize for Science and Technology
Decree No. 18/2024/ND-CP of the Government clearly stipulates the conditions and criteria for considering the award of the Ho Chi Minh Prize and the State Prize for Science and Technology.

For authors: Directly creating and contributing to the scientific and technological value of the work; not violating the provisions of Article 8 of the Law on Science and Technology and meeting the following conditions:
For Vietnamese people: Comply with the Party's policies and the State's laws;
For foreigners: Respect the independence, sovereignty, unity, territorial integrity, laws and good customs and practices of Vietnam.
For projects: Valid documents, published according to regulations (except for projects with content related to state secrets), or applied in Vietnam;
The time the work is published or applied in practice is at least 3 years or the work has been effectively applied with innovation for at least 1 year from the time of submitting the application for consideration for the Ho Chi Minh Prize or the State Prize for Science and Technology.
Decree No. 18/2024/ND-CP also specifically stipulates the criteria for considering the award of the Ho Chi Minh Prize for scientific research works, technology development research works, and technology application works; as well as the State Prize for technology development research works and technology application works.
Decree No. 18/2024/ND-CP takes effect from April 10, 2024.
Amending regulations on registration of water recreation vehicles
The Government issued Decree No. 19/2024/ND-CP amending and supplementing a number of articles of Decree No. 48/2019/ND-CP dated June 5, 2019 of the Government regulating the management of activities of means of water recreation and entertainment.

Specifically, the People's Committee at the district level (formerly the People's Committee at the provincial level) organizes and manages the registration and management of water recreation and entertainment facilities that must be registered according to the provisions of this Decree and other relevant provisions of law.
The People's Committee at the commune level shall manage water recreation and entertainment facilities exempted from registration.
The Decree also amends and supplements Article 11 on the authority to agree and announce the opening and closing of operating areas in region 2.
Accordingly, the People's Committees of districts, towns, provincial cities, and centrally-run cities (District-level People's Committees) (formerly Provincial-level People's Committees) shall implement agreements and announce the opening and closing of operating areas in zone 2.
Before implementing a construction investment project, the investor shall contact the People's Committee at the district level to reach an agreement on location, scale, measures to ensure security, safety, rescue, and prevention of environmental pollution. Project investment shall be carried out in accordance with the provisions of law on investment and construction.
Decree No. 19/2024/ND-CP takes effect from April 10, 2024.
