Question: I just gave birth 2 months ago and am currently on maternity leave. Am I eligible for the Covid-19 support program?

Reply:Article 13 of Decision 23/2021/QD-TTg of the Prime Minister stipulates the subjects and conditions for support as follows: Employees working at enterprises, cooperatives, public service units that self-insure regular expenses or investment and regular expenses, private educational institutions at preschool, kindergarten, primary, secondary, high school, vocational education levels (hereinafter referred to as enterprises, cooperatives, public service units, educational institutions) that must temporarily suspend operations at the request of competent state agencies to prevent and control the Covid-19 epidemic will be supported when meeting the following conditions:

1. Suspending the performance of the labor contract, taking unpaid leave during the term of the labor contract, from 15 consecutive days or more, from May 1, 2021 to December 31, 2021 and the start date of the suspension of the performance of the labor contract, taking unpaid leave from May 1, 2021 to December 31, 2021.

2. Participating in compulsory social insurance in the month immediately preceding the time the employee temporarily suspends the performance of the labor contract or takes unpaid leave.

Because you are not an employee who has to temporarily suspend the performance of your labor contract, take unpaid leave, but take maternity leave, you are not eligible for support under this regulation.
