The Government Inspectorate said that many projects in Ninh Binh in the 2011-2022 period violated planning regulations, were behind schedule, and had shortcomings in land use fees.
This information is stated in Conclusion No. 203 on land management and use in Ninh Binh in the period 2011-2022 recently announced by the Government Inspectorate.
According to the Government Inspectorate, most of the construction planning levels in Ninh Binh were established, approved and implemented during the above period. The Provincial People's Committee has focused on investing resources in construction planning, contributing to improving the management of investment activities, basically meeting the goals of socio-economic development, national defense and environmental protection.
However, this agency believes that the planning and implementation of construction planning have not been strictly managed, and there are still some limitations and shortcomings such as not issuing plans to implement planning projects, slow implementation of higher-level planning, low coverage rate of detailed planning, narrow planning scope, fragmentation, lack of organization... mainly serving short-term goals, not improving land use efficiency, and not fully exploiting the development potential of the locality.
Through inspection of 18 projects, the Government Inspectorate discovered that 7 projects had approved planning that was not in the correct proportion, had not adjusted the general planning, and the planning criteria were not consistent with the higher-level planning or construction standards; the project had a scale of over 5 hectares but did not have a detailed 1/500 planning and did not arrange social housing.
These projects include the Yen Thang Lake 54-hole golf course and tourism complex, Dong Thai Lake eco-tourism area, the Eastern bus station of Ninh Binh city, the high-end wood processing factory in Xich Tho commune, Binh Minh residential area (Nho Quan district), Gian Khau industrial park, the new urban area north of Ninh Binh city and Hoa Lu district.
7 projects are behind schedule compared to the investor certificate and have limitations, shortcomings, and violations in determining land use fees, land rent, not determining additional land rent, late payment of rent, and not adjusting rental prices after the end of the 5-year stabilization period. 5 projects have investors accepting the transfer of agricultural land use rights without written permission from competent authorities.
3 projects violated procedures when approving investment policies without planning and land use plans, not in accordance with the general planning for new rural construction, urban planning including the eco-tourism area and Golden Cuc Phuong Villa, the Eastern Bus Station of Ninh Binh City, and the Wood Processing Factory in Xich Tho Commune.
Regarding the implementation of financial obligations, the inspection agency identified 48 projects and works that still owe more than 50 billion VND in fees for protection and development of rice fields. 125 projects have not been identified. 79 projects owe more than 194 billion VND in land rent, of which 59 organizations owe about 193.5 billion VND.
The Government Inspectorate recommended that the Prime Minister direct the Chairman of the Ninh Binh Provincial People's Committee to review and correct the above violations. At the same time, this agency also requested the Prime Minister to direct the State Bank to inspect and review the transfer and valuation of more than 66.8 million shares (75% of capital) at PV-Inconess Company from Vietinbank Fund Management Company Limited to TCG Land (related to the Dong Thai Lake eco-tourism project and the 54-hole Yen Thang Lake golf course). This is to ensure that the valuation of shares and the transfer are in accordance with legal regulations.
