According to the 2019 Labor Code, employees are entitled to take a day off with full pay on the following holidays and Tet: New Year's Day is 1 day off (January 1); Lunar New Year is 5 days off; Victory Day is 1 day off (April 30); International Labor Day is 1 day off (May 1); National Day is 2 days off (September 2 and 1 day before or after); Hung King's Commemoration Day is 1 day off (March 10 of the lunar calendar).

In 2025, New Year's Day falls on Wednesday, January 1, 2025. Thus, on New Year's Day 2025, workers will have 1 day off and receive full pay.

The Labor Code stipulates that every year, based on actual conditions, the Prime Minister decides on the Lunar New Year (Lunar) holiday and National Day. In 2025, the Ministry of Labor, War Invalids and Social Affairs only proposed a 9-day Lunar New Year holiday and swapped holidays so that the National Day on September 2 would be 4 days off (according to option 1).

Currently, the Ministry of Labor, War Invalids and Social Affairs is compiling and completing the process of collecting opinions from agencies, ministries and sectors on the Lunar New Year and National Day holidays to submit to the Prime Minister. Usually, the Lunar New Year and National Day holiday schedule will be decided around October and November. This helps agencies, businesses and workers have time to plan production, business and rest.
