With the resolute participation from the grassroots, violations in agricultural land use in Kinh Mon town have been gradually eliminated.
Quang Thanh Commune People's Committee has forcibly removed the illegal construction of Mr. Ngo Van Son's family in Hamlet 12, Tong Thuong Village.
Resolutely handle
In June 2021, Mr. Ngo Van Son in Hamlet 12, Tong Thuong Village (Quang Thanh Commune) built a 29.9 m2 house on the conversion area in the same village. The house was built with a roof, covered with cold corrugated iron, without rafters. Because Mr. Son violated Point a, Clause 2, Article 11, Decree 91/2019/ND-CP dated January 19, 2019 of the Government regulating administrative sanctions in the field of land, the People's Committee of Quang Thanh Commune made a record and fined 3 million VND. However, Mr. Son's family did not pay the fine and did not dismantle the construction themselves despite being propagandized and mobilized by the authorities. In July 2021, the People's Committee of Quang Thanh Commune organized the enforcement and demolition of the violating construction.
According to the People's Committee of Quang Thanh commune, from September 1, 2020 to September 2021, there were 6 violations on agricultural land in the commune, mainly illegal construction, land use for the wrong purpose... The People's Committee of the commune forcibly dismantled 2 constructions, the remaining cases, when informed, proactively took remedial measures.
In order to prevent violations on agricultural land, many wards and communes have increased inspections to quickly detect violations and take timely measures. In 2020, Mr. Nguyen Van Nhiem's family in La Xa village (Thuong Quan commune) built a steel frame house with an area of 200 m2 on agricultural land. The People's Committee of Thuong Quan commune sent officials to propagate and mobilize, and Mr. Nhiem's family proactively dismantled the illegal construction.
According to Mr. Bui Van Luong, Chairman of the People's Committee of Thuong Quan Commune, in 2020, there were 2 violations in the commune and in 2021 there was 1 violation on agricultural land, but the locality resolutely handled it immediately. Therefore, it has limited the waste of people's efforts and money, and at the same time avoided complications in the process of handling violations.
Government intervention
One of the reasons for violations on agricultural land in Kinh Mon is that in previous years, people did not understand the regulations on construction or construction on converted land. However, there were also some cases where people still deliberately violated the regulations despite being informed and mobilized. The authorities of some localities were not close enough, allowing people to build works and houses before discovering them and were not resolute in handling violations.
Since 2020, the People's Committee of Kinh Mon town has issued many documents regulating the handling of violations on land in general and agricultural land in particular. Most recently, on April 16, 2021, the People's Committee of the town issued a plan to enhance the responsibility of authorities at all levels in handling newly arising violations of urban order, traffic safety corridors and illegal construction on agricultural land in the town. In which, from August 2021, the People's Committees of communes and wards will regularly inspect and handle newly arising violations of illegal construction on agricultural land and other violations in the field of land.
In response to the drastic direction of the Kinh Mon Town People's Committee, localities have proactively taken action. According to Mr. Tran Van Chu, an officer of land administration, agriculture, construction and environment of Quang Thanh commune, in October 2020, the Quang Thanh Commune People's Committee developed a plan to handle violations on agricultural land. The commune strives to prevent new violations from arising, while focusing on handling more than 100 households that have violated in previous years. "We have made a list of each household with specific violations and will take measures to handle them in the coming time. Violations arising after October 2020 will be resolutely handled," said Mr. Chu.
Mr. Nguyen Dinh Luu, Deputy Head of the Department of Natural Resources and Environment of Kinh Mon town, said: "Up to now, there are no specific statistics on handling violations on agricultural land of communes and wards, but in general, localities have actively participated and seriously implemented the town's direction, so no new violations have occurred."
In addition to the determination of local authorities, people's awareness plays an important role. In 1997, Mr. Nguyen Huu Tam's family in Thuong Xa village (Thuong Quan commune) built a 20 m2 house outside the conversion area. Later, due to the need for use, he built an additional room of about 9 m2 behind this house. Over the years, the house above was damaged and could not be used anymore. In early 2021, his family demolished the upper part, intending to keep the foundation to rebuild the house. When they learned of this intention, the People's Committee of Thuong Quan commune came to propagate and mobilize, and Mr. Tam agreed to live in the 9 m2 room without building a new house.
