Organizations and individuals using urban land after January 5, 2020 without registration can be fined up to 10 million VND.
This information is stated in the draft Decree on administrative sanctions for violations in the land sector drafted by the Ministry of Natural Resources and Environment, which is being consulted.
According to regulations, when using land for the first time, it is necessary to register and declare the legal status of land use rights, house ownership rights, other assets attached to land and management rights when starting to use the land. When there is a change (transfer, inheritance, donation...), the land user also needs to declare.
According to the current Decree 91/2019, in rural areas, if the first land registration is not carried out within 24 months from January 5, 2020, the person will be warned or fined from 500,000 VND to 1 million VND. If the deadline is over 24 months, the organization or individual will be fined 1-2 million VND. In urban areas, the corresponding fines are 1-2 million VND and 2-4 million VND.
However, in the new draft, the Ministry of Natural Resources and Environment is proposing to increase the fine for both areas. Specifically, using land in rural areas before January 5, 2020 without registration will be fined 2-3 million VND. In case of using land after this date without registration, the fine will be 3-5 million VND.
The fine for urban areas is double that for rural areas. Thus, individuals and organizations using urban land after January 5, 2020 without first registering the land can be fined up to 10 million VND, an increase of 6 million compared to current regulations.
Regarding land change registration when transferring, inheriting, donating land use rights..., the new draft also stipulates that the minimum fine for failure to comply will increase by 1 million VND per violation.
Currently, if you are late in registering land changes in rural areas, you will be fined at the levels of 1-3 million and 2-5 million VND. In the new draft, the fine is increased to 2-3 million and 3-5 million VND. The corresponding fines for urban areas are 4-6 million and 6-10 million VND.
