Cancel the emulation title if there is fraud in declaring achievements

This is one of the important new contents in the draft Law on Emulation and Commendation (amended) that was recently commented on by the National Assembly Standing Committee at its 7th session on the morning of January 18.

Ms. Nguyen Thuy Anh, Chairwoman of the Social Committee, said that through synthesizing the opinions of the National Assembly deputies at the 2nd Session, the majority of the National Assembly deputies agreed with the provisions of the draft Law on handling violations in emulation and rewards. There were opinions suggesting adding cases where individuals violate State regulations from the form of reprimand or higher during the commendation period but are later discovered, the commendation decision will be revoked and the prize and cash will be revoked.

Ms. Nguyen Thuy Anh, Chairwoman of the Social Committee, presented a report at the meeting.

The Standing Committee of the Social Committee accepted the opinions of delegates and revised Article 92 of the draft law. Notably, the regulation on canceling emulation titles or forms of commendation, and recovering physical objects and bonuses in cases of fraud in declaring achievements; Appraising, considering, approving, and proposing emulation titles and forms of commendation that are not in accordance with regulations.

An individual who commits a crime and is sentenced to a term of imprisonment or longer, or a commercial legal entity who commits a crime and is sentenced to permanent suspension of operations, shall have their state honorary title revoked. In case the court re-examines and finds that they have not committed the above crime, their state honorary title shall be restored and re-awarded.

Appreciating the proposal to add the above regulation, Chairman of the Law Committee Hoang Thanh Tung said that there have been cases where the title of Hero of the People's Armed Forces was revoked because of false declaration of achievements. However, what he is concerned about is whether the regulation that if a person is sentenced to prison, the title will be revoked is appropriate when there are people who commit crimes unintentionally.

“There are many forms of crime. There are acts related to the character and personality of the offender, so there is nothing to say, but what about unintentionally causing a house fire that leads to great damage, causing a traffic accident and being sentenced to prison? We should be specific about which group of crimes will result in the title being stripped, not general,” said Mr. Hoang Thanh Tung.

Commenting on this content, National Assembly Chairman Vuong Dinh Hue emphasized that it must be clarified because "public opinion says that there are enterprises that received medals but are related to the case". Which violates the law on emulation and rewards, and which does not.

"When the declaration is correct, the process is correct, the agency proposes based on the achievements at that time, but later when the case is discovered, whether the case is revoked or revoked, should be clearly regulated," said Mr. Vuong Dinh Hue.

The draft Law on Emulation and Commendation (amended) was first commented on at the 2nd Session and will be submitted to the National Assembly for consideration and approval at the 3rd Session next May.
