Hai Duong is implementing many solutions to build communes, wards and towns that meet legal access standards, contributing to promoting administrative reform, ensuring security, order and social safety.
Some communes have not achieved
At the end of 2022, the Investigation Police Agency of Cam Giang District Police prosecuted Nguyen Ngoc Duong, Chairman of the People's Committee of Cam Giang Town (Cam Giang) for the crime of abusing his position and power while performing official duties. Mr. Duong was prosecuted for his involvement in the auction of the right to use a land plot with a total area of over 4,913 m2, divided into 50 lots at the planned location of the residential area, martyrs' cemetery, Van Chi area, and Cam Giang town swimming pool. The court then sentenced Nguyen Ngoc Duong to 25 months in prison for disturbing public order, 15 months in prison for the crime of abusing his position and power while performing official duties, with a total sentence of 40 months in prison.
Thus, Cam Giang town has officials prosecuted in 2022, so it does not meet target number 3 and criterion number 5 according to Decision No. 25/2021/QD-TTg dated July 22, 2021 of the Prime Minister regulating communes, wards and towns meeting legal access standards.
In Gia Tan Commune (Gia Loc), at 8:30 p.m. on September 15, 2022, Ho Si Tan (born in 1994, residing in Gia Tan Commune) broke into the house of Mr. Nguyen Tuan K. and Mrs. Nguyen Thi T. (both born in 1960) to steal. When discovered by Mrs. T., Tan slashed the couple, causing Mr. K. to die and Mrs. T. to suffer 44% bodily injury. The People's Court of Hai Duong Province sentenced Ho Si Tan to life in prison for murder, robbery, and theft. Due to this incident, in 2022, Gia Tan did not meet the standards for access to the law.
According to the assessment and recognition results of communes, wards and towns meeting legal access standards in 2022, Hai Duong has 229/235 commune-level units meeting legal access standards, a decrease of 4 localities compared to 2021. 6 localities that did not meet the standards are Lien Hong commune (Hai Duong city) with the Chairman of the People's Committee being disciplined, and the civil servant in charge of justice and civil status forced to resign; Gia Tan commune (Gia Loc) with a serious crime; Gia Loc town with a drug case; Phu Thu ward (Kinh Mon) with officials and civil servants being disciplined; Cam Giang town (Cam Giang) with the Chairman of the People's Committee being prosecuted; Thanh Thuy commune (Thanh Ha) with a civil servant in charge of land administration, construction and environment being prosecuted.
All 6 of these localities did not meet criteria 3 and 4 of criterion 5 on organizing the assurance of national security, order and social safety according to Decision No. 25/2021/QD-TTg of the Prime Minister.
Strive to meet the standards
After failing to meet the legal access standards in 2022, from the beginning of 2023, the Party Committee and the Gia Tan commune government have strengthened the Steering Committee, developed a specific plan, especially focusing on the limitations of the previous year to prevent serious crimes, strengthen the dissemination and education of law, grassroots mediation, and determined to meet the legal access standards in 2023. In 2023, Gia Tan commune organized 35 legal dissemination sessions for people and had more than 200 online legal knowledge exams. Citizen reception was carried out seriously. During the year, the commune only had 2 petitions on social insurance and land that were promptly resolved. Security and order were ensured. The team of cadres and civil servants working at the "one-stop" department promoted the spirit of responsibility in serving the people. Up to now, the commune has self-assessed that it has basically met the legal access standards in 2023.
According to Chairwoman of Thanh Thuy Commune People's Committee Nguyen Thi Thu, in addition to implementing specific plans to implement targets and criteria according to regulations, the Party Committee and the Thanh Thuy Commune government have strengthened the dissemination of discipline and order to cadres and civil servants, raising awareness and responsibility in performing public duties. The locality has promoted diverse legal education and dissemination activities with skits at competitions, leaflets, and on the loudspeaker system.
Comrade Le Van Ngoan, Deputy Director of the Department of Justice of Hai Duong province, said that 2023 is the second year that localities have implemented scoring and recognizing communes that meet legal access standards according to Decision No. 25/2021/QD-TTg and Circular No. 09/2021/TT-BTP dated November 15, 2021, so the implementation of scoring procedures and completing records has been less confusing. Communes, wards and towns have clearly understood the purpose and significance, and have seriously implemented the construction of localities that meet legal access standards.
The Department of Justice continues to strengthen the organization of training and professional skills for civil servants working in the field of legal access standards in localities. Strengthen inspection, guidance, propose solutions to overcome, improve, and effectively implement criteria and targets and build communes that meet legal access standards based on annual assessment results, focusing on areas that have not met or have many criteria and targets with low results. By 2024, Hai Duong strives for 100% of communes, wards, and towns to meet legal access standards.
