Proposal to buy information to handle traffic violations up to 5 million VND

The Ministry of Public Security proposed spending 10% of the total fine for each case to buy information to handle traffic violations, but not more than 5 million VND.

The draft Decree on management and use of funds collected from administrative fines for violations of road traffic order and safety and vehicle license plate auctions is being consulted by the Ministry of Public Security, in which it is proposed to allocate 70-85% of the revenue from fines for road traffic violations and 30% from vehicle license plate auctions to the industry.

According to the draft, in addition to the police force, other agencies are allowed to use from 15 to 30% of the revenue from traffic violation fines, including: the National Traffic Safety Committee; the Ministry of Transport, People's Councils and People's Committees of provinces and cities; provincial and district traffic safety boards; and forces participating in ensuring security and order.

The Ministry of Public Security, a force involved in ensuring traffic safety under the police sector, is allowed to use funds deducted from the auction of vehicle license plates. Of which, the deduction from traffic violation fines and vehicle license plate auctions is used by the police force to modernize facilities, vehicles, and equipment to ensure security, order, and traffic safety.

The money deducted from traffic violation fines is used to pay for conferences, seminars, and talks; training, education, and professional development on traffic safety. In particularly serious accidents, families of deceased people are supported with up to 10 million VND; those seriously injured are supported with 5 million VND.

Officers and soldiers participating in ensuring traffic safety at night are supported with 200,000 VND/person/shift, with a maximum of 10 shifts per month. Those working to prevent traffic congestion in Hanoi, Ho Chi Minh City, Hai Phong, Da Nang, and Can Tho are supported with 100,000 VND/shift/person; the maximum number of shifts supported varies in each city, with Hanoi and Ho Chi Minh City receiving a maximum of 15 shifts/month.

The police will also spend 10% of the total fines to buy information to handle traffic violations, but not more than 5 million VND. In addition, there are many other expenses such as drafting legal documents, policy surveys, statistics and digitizing traffic safety data...

The idea of ​​paying for traffic violation information was raised by the Traffic Police Department in April 2022. Accordingly, this unit said that it would propose a mechanism to pay people to buy those images and videos, because not all authorities have surveillance cameras. People can send clips recorded by themselves or on their car's dash cam to the Traffic Police Department, Ministry of Public Security. The Department will have an information portal to receive all that information for verification and processing. This news buying mechanism is applied by many countries such as the US, South Korea, etc.

According to the draft, the 30% of the money deducted from the license plate auction will be used to rent vehicles for crime prevention; train officers and soldiers on license plate auctions and vehicle registration and management, ensuring traffic safety; verify suspected cases of collusion in price-fixing and violations of auction regulations; answer questions about license plate auctions; communicate, send messages and invoices to bidders, etc.

The Law on Road Traffic Safety and Order, passed by the National Assembly in June, stipulates that the State will allocate corresponding amounts from fines for administrative violations of road traffic safety and order and vehicle license plate auction fees after being submitted to the state budget to strengthen and modernize infrastructure and vehicles, ensuring security, order and traffic safety.

Explaining this content, the National Assembly Standing Committee said that in recent years, the National Assembly has allocated the budget in the direction of arranging the budget expenditure estimate for 100% of the revenue from administrative fines for violations in the field of road traffic safety after submitting it to the state budget.

The allocation rate for the Ministry of Public Security and localities depends on the needs of each year, however, the implementation process is difficult because it is not yet regulated by law.

After the Law is passed, the National Assembly assigns the Government to issue documents to specify the scope of application, scope of arrangement, items to be arranged, use of funds, preparation of estimates, allocation of estimates and finalization of funds on the basis of compliance with the law on state budget to facilitate and unify the implementation process.

According to the report of the National Assembly Standing Committee, in the period 2018-2020, the rate of police force deducting money from traffic violation fines was 70%; in 2021, it was 70%; in 2022 and 2023, it was 79%.
